【摘要】 昔日异常神秘的计算机如今己走进了各行各业,走进了千千万万寻常百姓家,计算机网络的应用呈现出前所未有的社会化趋势,我们迎来了憧憬已久的信息时代。计算机、网络的普及不仅改变了人类的生活方式也使得曾经形成的法学理论、人与人之间的法律关系受到极大冲击,网络空间普遍存在的名誉侵害就是如此。名誉权是民事法律关系主体一项重要的人格权,现实社会对名誉权保护的法律制度比较完备,人们的保护意识也比较强。但在网络空间,在这个号称言论不受束缚世界里,网络主体特别是虚拟主体是否享有名誉权,则颇有争议。作为一种特殊的侵害名誉权的方式,网络名誉侵权有自己的特点。通过对其分析,有利于更深入地认识并有效遏制网络名誉侵权。本文针对网络名誉侵权这一问题,共分四章进行了探讨:第一章简要介绍了名誉权和网络名誉权的基础理论知识,对虚拟主体的名誉权以及网络名誉侵权的特征和主要途径进行分析,也为以下各部分对网络名誉侵权行为的分析做以铺垫。第二章针对网络名誉分权的基本问题作探讨.我们在网络上应该享有充分的言论自由,但任何自由从来都不是绝对,如何保障网络言论自由又不侵害网络名誉权,是本章探讨的问题之一.之二是针对网络名誉侵权民事责任的认定及抗辩事由加以分析。第三、四章是本文的重点.第三章从法律保护的角度出发对网络名誉权存在的问题进行论述。由于网络名誉侵权的特殊性,它较之于一般的名誉侵权诉讼有着更多的困难,主要是原告、被告资格的确定,电子证据的搜集和司法管辖地的确定;针对困难笔者提出解决的方法。第四章首先介绍了德、美等国有关网络名誉权的保护实践,对各国的法律规定加以总结,结合我国的立法现状对网络名誉权的保护提出建议。本文的目的在于从侵权行为法的角度对网络名誉侵权行为加以分析,旨在使大家对网络名誉侵权问题有一个比较系统的了解,从而提高网络名誉意识,用法律武器来保护自己的网络名誉权,同时也懂得不去侵犯他人的网络名誉权,为完善我国网络名誉权的立法及促进实务界依法保护网络名誉权尽微薄之力。更多还原

【Abstract】 Nowadays the former mysterious computers have come into the every walk of life and come into the homes of millions of common people. Application of computer network has been an unprecedented socialization trend; we are facing a yearning information age. The popularization of computer and network not only changes the life style of people, but also challenges the existed legal theories and interpersonal relationship in law. The widespread reputation infringement in cyberspace is a good example. Reputation right is an important personality right of the subject in civil law. In the real world the legal system of reputation right protection is comparatively sound and people have a stronger consciousness of protection. But in cyberspace, the so-called world of free speech, it is controversial that whether the net subject, especially the virtual subject, has the reputation right or not. As a special way of reputation infringement, the reputation infringement in cyberspace has its own traits. Through the analysis, it is easy to further understand and effectively control the reputation infringement in cyberspace.This thesis discusses the reputation infringement in cyberspace by four chapters: Chapter 1 briefly introduces the basic theories of reputation right and cyberspace reputation right, analyzes the traits and main way of the reputation right of virtual subject and the reputation infringement in cyberspace, and prepares for the following analysis of reputation infringement in cyberspace. Chapter 2 discusses the fundamental issues of reputation infringement in cyberspace. Weshould enjoy full freedom of speech on net, but no freedom is absolute. How to guarantee the right of free speech and meanwhile the reputation right in cyberspace is one of the issues discussed in this chapter. The second is analysis of the cognizance and plea of the civil responsibility of reputation infringement in cyberspace.Chapter 3 and 4 are the key parts of the thesis. Chapter 3 discusses the problems of reputation right in cyberspace from the perspective of legal protection. Compared with lawsuits of general reputation infringement, reputation infringement in cyberspace has more problems due to its particularity. And the main problems are qualificatory determination of accuser and defendant, collection of electronic evidence and determination of judicatory venue; the author brings forward some solutions to the difficulties.Chapter 4 firstly introduces practical protection of the reputation right in cyberspace in Germany, US and so on, and summarizes the legal provisions in various countries, lastly offers proposals for the protection of the reputation right in cyberspace with the current situation of China’s legislation. This thesis aims to analyses cyberspace reputation infringement from the view of law of infringement act. It makes us understand the problems of systematically in order to improve the sense of our cyberspace reputation and protect ourselves’cyberspace reputation right by lawful weapons .Meanwhile, it also reminds us do not infringe others’cyberspace reputation right .更多还原
