缺陷产品召回制度研究

【摘要】 随着人们生活水平的日益提高，人们对所购买的产品的质量也越来越关注。因此，世界上许多发达国家都建立了比较完善的产品质量法律体系。其中，调整产品质量法律关系的一个重要制度，即缺陷产品召回制度，也已经建立并发挥着越来越重要的作用。我国于2004年3月15日颁布了《缺陷汽车产品召回管理规定》，并于2004年10月1日起开始实施。这是我国第一次实施召回制度，从而填补了我国在召回法律制度方面的空白。从该项制度颁布至今，已经经过了两年多的时间，它在实际生活中发挥了重要的作用，也被生产者及广大消费者所接受，但是，随着时间的推移，这项制度自身所存在的问题也日益显现出来。近年来，一系列涉及产品缺陷召回制度的事件频繁发生，如东芝笔记本电脑事件、福特汽车召回事件、雀巢奶粉事件、“苏丹红”事件等，这一系列问题的出现，正是由于我国目前的产品召回制度尚不完善而引发的。因此，本文试从缺陷产品及产品召回制度的界定入手，比较分析国外的缺陷产品召回制度，通过对我国现行立法状况以及我国建立产品召回制度的必要性及意义的分析，提出对我国建立缺陷产品召回制度的设想。文章共分四个部分：第一部分主要介绍了召回制度的相关概念。阐述了缺陷产品及召回制度的概念，以及与相关概念的区别。第二部分介绍了产品召回制度的发展历史及各国的产品召回制度。通过了解不同国家的产品召回制度，为弥补我国产品召回制度的不足及完善我国的产品召回制度提供经验参考。第三部分对我国的产品召回制度的现状进行分析，通过对产品召回制度现状的概述，阐述我国的产品召回制度的不足之处。第四部分提出了建立我国产品召回制度的设想。通过完善立法及相关配套措施，改进我国现行的产品召回制度，以期它能在实践中更好的得到实施，最大限度的发挥其应有的作用。更多还原

【Abstract】 With people’s daily life enhance, they pay more and more attention on quality .Therefore, in the world many developed countries have made a perfect product quality legal framework. Among them, an adjustment product quality legal relationship important system, named the flaw product recalled system, also already established and isplayed the more and more vital role. Our country promulgated "FlawAutomobile Product to March 15, 2004 To recall ManagementStipulation", and got up to October 1, 2004 starts to implement. This is the our country’s first implementation that recalled system, that filled our country to recall the legal system aspect the blank.From promulgated this system until now, already passed more than two years , it has played a very important effect on the life, also accepted by the producer and the general consumers.But with time passed, the question which this system’s own existed also day by day appears. In recent years, a series of involved the product flaw to recalled system the event frequently occurrence, like the Toshiba notebook computer event, the Ford automobile recalled the event, Nestle the powdered milk event, "red" the event and so on. This series of questions appear,that was our country’s product recalled system still not initiate perfectly at present .So this article tries on the flaw product and the product recalled system limits to obtain, the comparative analysis overseas flaw product recalled system, through establishesthe product to our country present legislation condition as well as our country to recalled system the necessity and the significance analysis, proposed establishes the flaw product to our country to recalled system the tentative plan.The first part mainly introduced recalled system the relatedconcept. Elaborated the flaw product and recalled system theconcept, as well as with correlation concept difference.The second part introduced the development history of the product recalled system and the various countries’ product recalled system. Recalled system through the understanding different country product, for making up our country’s product recalled system better. The third part analysis recalled system of our country product the presentsituation, through recalled system present situation to the product the outline, elaborated our country product recalled system the deficiency.The fourth part proposed establishes of our country’s recalled system plan.
