东江源饮用水源地保护区法律机制构建

【摘要】 饮用水源地保护问题随着饮用水源的紧缺及污染的日趋严重，逐渐受到各国的重视，在国内跨行政区饮用水源地流域管理的立法也逐渐受到重视。协调饮用水源地流域区际的利益关系，做好流域的一体化管理保护，是饮用水源地保护立法的前提。本论文以东江源饮用水源地保护区为题，重点探讨饮用水源地保护区的法律调控措施，以期对完善或创新东江源饮用水源地保护区法律调控的理论和实践提供依据和思路。论文共分六个部分。前言简要地阐述了论文的选题意义、国内外研究现状、研究思路和研究方法。第一章：“东江源国家保护区水源地概述”，首先介绍东江源国家保护区及其流域地区的概况，对饮用水源保护的概念和特征作出明确地界定。第二章：“饮用水源保护法律调控的理论基础”分析和论证了饮用水源保护的必要性，进而阐明了饮用水源保护法律调控的理论基础。第三章：“国外关于饮用水源保护的法律机制”，主要从比较的角度，论述了国外饮用水源保护法律调控的背景、立法实践等，大多数西方发达国家都已经建立起适合本国具体情况的较为完善的流域管理体制，流域管理从流域整体出发对流域内一切涉及到环境资源使用及保护的问题进行综合管理，对于流域内各种资源的合理开发利用、流域环境保护以及促进流域可持续发展起着积极的作用。其流域管理也基本由以水污染综合防治，水生态环境的恢复为目的的管理转变为可持续性的流域水资源—环境—生态的综合管理。重点剖析了其管理体制和基本法律制度的利弊。第四章：“我国饮用水源保护法律”，对我国饮用水源现状和现行饮用水源保护的法律规定进行了深入的分析，我国已经进行了许多水资源管理的立法，其中包括一些关于跨行政区水资源管理的规定，这些立法在我国的水资源管理中发挥了重要的作用。然而，我国的水资源管理立法也存在许多问题，包括缺乏完整的跨行政区水资源管理的政策、法规体系不健全、管理制度不完善、管理体制不能适应实际管理的需要、对法律的执行缺乏公众监督机制等。解决这些问题需要改变目前的一些立法原则和制度安排。指出现行法律的规定已不能满足饮用水源保护的现实需要，而且立法上还存在着诸多的法律空白。第五章：“东江源饮用水源地保护区法律机制构建”是本论文的重点，是作者在前几章研究的基础上，对如何完善或创新东江源饮用水源地保护区法律机制的理论和实践所作的独立探讨。可持续发展战略作为一种新的发展模式，是当代人类的普遍共识。因此，东江源饮用水源保护立法应当以可持续发展思想为指导，完善和创新饮用水源保护的基本原则、管理体制和基本法律制度。更多还原

【Abstract】 Because the worldwide basis drinks the water source crisis which the water source scarce and the pollution causes, not only is threatening people’s life and health and the survival seriously, moreover possibly initiates the international politics question as necessary. Therefore, drank the water source the protection to raise the various countries agenda, and became the focal point which the international society paid attention together. The present paper drinks the water source take the Dong Jiang source the protection as a topic, the key discussion drinks the water source protection the legal regulation measure, or innovates the Dong Jiang source by the time to the consummation to drink the water source protection law regulation the theory and the practice provides the basis and the mentality.The paper altogether divides six parts. The foreword elaborated the paper selected topic significance, the domestic and foreign research present situation, the research mentality and the research technique briefly.First chapter: "The Dong Jiang source country protectorate water source outline" , first introduced the Dong Jiang source country protectorate and the basin area survey, to drinks the water source protection the concept and the characteristic makes is clear about the boundary to decide.Second chapter: Drank the water source protection law regulation the rationale; to analyze and to prove has drunk the water source protection the necessity, then had expounded drank the water source protection law regulation the rationale.Third chapter: Overseas about drinks the water source protection the legal mechanism, mainly from the comparison angle, elaborated overseas has drunk the water source protection law regulation the background, the legislation practice and so on, analyzed its management system and the basic legal regime advantages with emphasis. Fourth chapter: Our country drinks the water source protection law, drank the water source present situation to our country and present drinks the water source protection the legal rule to carry on the thorough analysis, pointed out present legal the stipulation has not been able to drink the water source protection satisfiedly the realistic need, moreover legislated on also has many legal blanks.Fifth chapter: The Dong Jiang source tap water source area protectorate law mechanism construction is the present paper key point, is the author in the first several chapter of research foundation, how to consummates or innovates the independent discussion which the Dong Jiang source tap water source area protectorate law mechanism theory and the practice does. The sustainable development took one kind of recent development pattern, is the contemporary humanity’ s universal mutual recognition.
