【摘要】 如何在侦查程序中加强对犯罪嫌疑人的权利保障是刑事诉讼法学中的重要问题，对犯罪嫌疑人权利保障的程度关系到一国刑事诉讼活动在公正、民主和科学方面的建设进程。本文紧紧围绕这一主题，结合我国实际国情而展开论证。本文共分四部分。第一部分通过微观法律层面和宏观社会层面，强调我国侦查程序中加强犯罪嫌疑人的权利保障的必要性。因为只有认识到这种必要性，才能完善立法，转变观念执法者，真正落实对犯罪嫌疑人的权利保障。第二部分比较了两大法系不同侦查模式下犯罪嫌疑人的权利保障机制，寻找法治发达国家成熟、科学的制度和理念。第三部分着重考察我国侦查程序中犯罪嫌疑人权利保障的立法和司法现状，并对比1996年刑事诉讼法修改前后实际司法的状况，指出目前我国对犯罪嫌疑人权利保障存在的不足和缺陷。第四部分立足于上述研究，对如何完善我国侦查程序中犯罪嫌疑人权利保障机制提出了一些建议，包括扩充犯罪嫌疑人的权利内容、加强其外部保障和对其充分救济等。更多还原

【Abstract】 It is an important issue on how to strengthen rights protection of criminal suspects during the investigating period of criminal procedure. The degree of protecting the criminal suspects rights symbolizes construction progress in fair, democratic and scientific direction of one nation’s criminal procedure law. Thisessay closely revolves this subject by analyzing actual national condition in China.The first part emphasizes the necessity of safeguarding the criminal suspects’ rights from microscopic legal aspect and macroscopic social aspect during investigating period of China. Only we realizes the necessity can we perfect legislation and transform the idea of enforcing the law so as to realize protecting the criminal suspects’ rights.The second part compares the different mechanisms of protecting criminal suspect’s right under different investigating patterns of two legal systems. The author tries to seek mature and scientific ideas and regimes in law confirmed by developed countries.The third part mainly analyzes the current situation on protecting criminal suspects’ rights in legislation and judicature in China. The author contrasts the current judicial situation to that before 1996 when Criminal Procedure Law was revised and points out insufficiency and flaws which exists in reality of China.The fourth part is some suggestions on how to strengthen the criminal suspects’ rights protection in the investigating period,which includes expanding criminal suspects’ rights, strengthening their exterior protection and providing them full relief and so on.更多还原
