行政指导的比较法学透视

【摘要】 行政指导是和现代市场经济、民主法治相关的一个概念。它是现代行政法中的平等、协商、合作等民主精神发展的结果，也是现代国家理念、市场经济、政府角色、行政模式不断演进的共同结果。二战后，行政指导在日本的经济社会中产生、盛行，随后为韩国、美国、德国、法国以及我国台湾地区等国家和地区普遍倚重。虽然行政指导以其独具的灵活性、民主性、间接性，在改变政府形象，培育行政民主，平衡政府与市场的关系等方面显示出了特殊的功效性和适应性，但与行政规制、行政处罚等传统行政行为相比，行政指导仍是一个理论基础薄弱、实务问题甚多、法治程度不高的行政现象，这就需要对其进行深入系统的研究。本文采取比较研究分析方法，在对一部分市场经济国家和地区关于行政指导法律规定研究的同时，重点选择日本、韩国、美国、德国、我国台湾地区的行政指导行为加以考察，透视各国行政指导的理论成果，实践经验及其相关因素，首先对行政指导进行了理论背景分析，比较了各市场经济国家和地区关于行政指导的概念界定，系统论述了各国行政指导实际运作机制，并对我国提出了程序立法建议，最后针对行政指导的运行现状寻求对其的监督与救济机制，并在此过程中揭示这些制度对正在进行中的我国行政指导制度构建的启示意义，期能为我国治理模式民主化和效能化服务。更多还原

【Abstract】 Administrative guidance is a concept of the modern marketing economy and democracy ruling of law. As a result of the development of equality、consultation、cooperation and democratic spirit in modern administrative law ,administrative guidance is also the evolution of the modern country idea、the market economy、the government role and the administrative pattern. After World II, administrative guidance emerged and has played an important role in the Japanese economic and social development. Then, it became popular in Korean, American, German, French as well as Taiwan area in our country. Because of its flexibility、democracy and indirect, administrative guidance has the special effect in the change of government、the cultivation of government image and the balance between government and market relation. But compared with traditional administrative action, such as administrative regulation、administrative punishment, it is also an important administrative phenomenon lacking in theoretical base, low in legalization and with many practical problems, so we need to research it in thorough system.This paper adopts the comparative analysis method, studies law of administrative guidance in a part of market economy countries and areas, then choices administrative guidance in Korean, American, German, French as well as Taiwan area in our country, carefully inquires into their background theory、experience and other factors. First, we analysis the theory background of administrative guidance, compared several concepts in each counties and areas, elaborated the actual operation mechanism, and put forward the procedure legislation proposal to our country. Finally, based on the present situation of administrative guidance, we seek to its relief system, and promulgated the enlightenment to our country in establishing the aim in administrative guidance system so as to serve the democratizations and efficiency of Chinese administrative mode.更多还原
