【摘要】 论文从以下三个方面来讨论道德精神和法律精神的关系及其嬗变：首先考察传统的道德精神和法律精神，然后探究现代社会中道德精神和法律精神的分离及意义，最后对道德精神和法律精神的整合作了新的思考。在传统社会，人们更倾向于从柏拉图的道德即人理性的生活方面去理解道德。道德的这种精神向度表现出来，就是中庸。而论文中的法律主要是就规则而言的。由于法律的诞生和财产概念的出现息息相关，法律规则中存在的物的因素使法律精神有走向极端的可能。但在传统社会中道德起主导作用，在道德精神的统摄下，法律精神走向极端的这种可能性没有表现出来。现代社会与法律精神紧密相联。社会秩序的结构安排是依靠社会分工及与之相应的文化象征符号的结合而实现的，道德和法律是其中两个重要的方面。在现代社会，当法律在社会生活中占据主导地位之后，工具合理性的意识形态确立了。在此语境中，道德也被要求去证明其自身具有某种功用。这样，道德自身存在的意义和其在社会中的作用发生了错位，使得社会和文化秩序出现了混乱。在对道德精神和法律精神的分裂进行反思后，我们认为这和人们极端的主体性是内在相关的。由于极端的、绝对的主体性把人变得片面、绝对，所以无视道德的社会出现了诸多问题。在此，生态智慧具有重要的借鉴意义。生态觉悟是对世界的合理秩序、对人在世界中的地位以及对人的行为的合理性的反省。我们希望在这种生态建设视野的有机联系中使道德和法律达到某种程度的整合。更多还原

【Abstract】 The relation and the evolution of the moral spirit and the legal spirit are discussed from the following three aspects: Firstly, studying the traditional moral spirit and the traditional legal spirit; Secondly, analyzing the division of the moral spirit and the legal spirit and its meaning in modern society; Thirdly, considering the conformity of the moral spirit and the legal spirit.In traditional society, people were inclined to consider morality from the angle of man’s rational life of Plato. This kind of spirit expressed by morality was the mean. Here law is discussed from the feature of rule. The emergence of law related to the emergence of the concept property, and the factor of object existing in law’s rules could make the legal spirit go to extremes. However, morality played a leading role in traditional society, so on this condition, the possibility of the legal spirit’s going to extremes didn’t come into reality.Modern society has a direct bearing on the legal spirit. The arrange of social order’s structure depends on the combination of social division of labor and the corresponding cultural symbols. Here, morality and law are two important aspects. In modern society, after law became the leading factor in social life, the ideology of instrumental reason was established. At this moment, morality was asked to prove itself have some use. Thus, the meaning of morality’s existence and its use in the society alternated, which confused the society and the cultured order.After considering the division of the moral spirit and the legal spirit, we think that it has something to do with man’s extreme subjectivity. Because extreme and absolute subjectivity make man unilateral and absolute, the society has many problems in which morality is ignored. Here, ecologic wisdom has significant use for reference. Ecologic consciousness is man’s consideration of the reasonable order of the world, man’s position in the world and the reasonableness of man’s behavior. We hope that in this kind of organic connection, morality and law will reach to the conformity to some extent.更多还原
