【摘要】 新贸易理论将规模经济和不完全竞争引入国际贸易理论的分析,为政府干预贸易提供了合理的解释,并奠定了WTO体制下的贸易救济措施选择适用的理论基础。WTO体制下的贸易救济措施具有“合法性”和“易发起性”特征,可以成为实施战略性贸易政策的工具。由于传统的战略性贸易政策的实施手段受到限制,选择适用贸易救济措施也就成为WTO体制下战略性贸易政策实施的客观要求。WTO体制下的贸易救济措施的成案要素有很多共同点:外来贸易损害行为、国内产业受到损害、外来贸易损害行为和国内产业损害之间存在因果关系。这些共性使选择适用贸易救济措施成为可能。比较分析贸易救济措施的具体成案条件上可知,不同的贸易救济措施在成案条件上可以相互重叠,在一个案件中完全可能包含两个以上贸易救济措施的成案条件,这就说明贸易救济措施具有可选择性。影响贸易救济措施选择的因素主要包括以下几点:适用贸易救济措施的目的和不同贸易救济措施的成本、效果和风险。适用贸易救济措施的目的主要有保护国内产业、维护自由贸易和维护公平贸易这几种;适用贸易救济措施的成本包括直接成本和机会成本;不同贸易救济措施的救济效果的不同主要体现在救济措施的影响范围和作用强度上;适用贸易救济措施的风险则指被报复的风险和在争端解决机制更多还原

【Abstract】 New trade theory introduces imperfect competition and economy of scale into analyzing of international trade theory, and gives government intervention a reasonable interpretation. The trade remedy measures under WTO system are legal and can be applied easily, so it could be the tools of strategic trade policy. Because the traditional means of strategic trade policy is restricted, the uses of trade remedy measures have been desirability to strategic trade policy.There are common elements in WTO system’trade remedy measures: injury of import, domestic industry being injured, and causality between injury of import and domestic industry being injured. The common elements make it possible to choose different remedy measures. Comparing the elements of trade remedy measures, we find that one trade remedy measure’element can include another measure’, so the trade remedy measures have selectivity in WTO system.There are various factors which influence the choice of trade remedy measure. In this paper I will analyze the follow four factors: aim, cost, effect and risk of different trade remedy measures. There are three main aims such as protecting domestic industry, free trade and fair trade in applying trade remedy measures. The cost to apply trade remedy measures includes direct cost and opportunity cost. Because the functionary scope and degree is different, the trade remedy measures’effect is various. And the risk includes retaliation and losing in DSB.更多还原
