【摘要】 自我国2001年《著作权法》首次明确提出信息网络传播权以来，关于信息网络传播权方面的研究也已经取得一定的进展，但是，研究的范围基本上是以互联网上信息传播的法律问题和数字图书馆的著作权保护为主。从广义上来说，移动通信网络也是网络的一种表现形式，并且通过此种网络而进行的信息传播方式越来越普遍，所以研究当中涉及到的著作权保护问题非常有必要。本文从信息法学角度，对目前数字化、网络化环境下，移动通信网络中的信息网络传播权法律问题进行了初步探讨。主要对以下几个方面的问题进行了研究：1、适用性问题。通过总结我国信息网络传播权确立的过程和解析信息网络传播权的法律特征，分析移动通信网络中的信息传播是否适用信息网络传播权。2、责任界定问题。在移动通信网络中著作权人的信息网络传播权被侵犯后，各种网络服务商包括网络接入提供商、信息内容提供商和应用服务提供商之间的责任如何界定。3、权利保护范围问题。是否应该对信息网络传播权进行限制和如何限制。由于目前我国对移动通信网络中信息网络传播权的法律问题研究还是比较稀少，所以本文希望能对这个方面的理论研究和司法实践提供有益的参考。更多还原

【Abstract】 Since the transmission right of information network was put forward in China’s CopyRight Law for the first time in 2001, some headway has been made in the research in this aspect. But the researches mostly aim at the protection of the authors’ copyright on the Internet or in the digital library. Covering a wide scope, the mobile communication network is a type of the network. With the rapid development of the information transmission in the mobile communication network, it’s very necessary to research the protection of copyright in this aspect. From the viewpoint of information law, this paper primarily discusses the legality of the transmission right of information network in the digital mobile communication. The paper discusses these questions: 1. About the application of law. The paper analyses the legal nature of transmission right of information network and the application of law for the information transmission in the mobile communication network. 2.About the definition of the tortious liability. While the tortious conducts happen to the authors’transmission right of information network in the mobile communication network, it’s necessary to distinguish the tortious liabilities among the ISPs (Internet Service Provider) including IAP(lnternet Access Provider),ICP(lnternet Content Provider) and ASP(Application Service Provider). 3. About the protection range. The paper discusses the reasons why to limit the transmission right of information network and how to limit it. Because the researches on the transmission right of information network are not plentiful, this paper maybe could offer some useful reference to either the theory research or the law application in this aspect.更多还原
