【摘要】 农业、农村和农民问题一直是困扰我国国民经济与社会发展的重要问题，而解决问题的关键之一是进一步完善我国的农地产权制度。本文基于这一出发点，在阅读大量国内外有关产权理论相关文献的基础上，对农地产权的概念和农地产权制度的基本理论进行了概括性总结，并结合我国农地产权制度变迁路径，重点分析当前我国在家庭联产承包责任制下农地使用领域出现的问题及问题出现的原因，最后提出我国农地产权制度改革的具体对策。除导论和结论外，本文共分为四个部分： 第一部分：农地产权制度的基本理论。通过对产权基本涵义和特征的剖析，得出农地产权的含义和农地产权制度的基本理论，并且归纳出农地产权制度对经济发展的三种效应，即资源配置效应、稳定性效应和社会保障效应； 第二部分：我国农地产权制度的变迁路径。以我国农地产权制度变迁路径为线索，逐个分析各个时期，各种农地产权制度的特点及其效应的发挥状况，重点描述当前我国农地产权制度即家庭联产承包责任制的制度安排； 第三部分：当前我国农地产权制度存在的主要问题及原因分析。重点分析当前我国在家庭联产承包责任制下农地使用领域出现的问题及问题出现的原因，得出根本原因在于所有权主体缺位、产权内容残缺和产权结构扭曲； 第四部分：深化农地产权制度改革的具体对策。通过描述四种当前农地产权制度下的实践创新，即两田制、规模经营、“四荒”使用权拍卖和农地股份合作制，剖析其实现条件和利弊，最后得出我国农地产权制度改革的三个具体对策：一是坚持农地集体所有的前提下，明确所有权的产权主体；二是完善产权内容，把永久土地经营权落到实处；三是调整产权结构，构建合理、有序的农地流转机制。更多还原

【Abstract】 The problem of agriculture, countryside and peasant badger our country’s economy and society development all the time, and one of solving methods is to adjust farmland property rights. Aiming at this, based on reading lots of literature about farmland property rights, the author summarizes the notion of farmland property rights and the basic theory of farmland property rights, and incorporates the transition route of farmland property rights in our country, analyzes genetic issues and the reason of issues in the houshold contract responsibility system, and finally expounds detailed countermeasures to farmland property rights of our country. Apart from preface and conclusion, this article includes four sectors:First: the basic theory of farmland property rights. Through analyzing connotation and characters of property rights, the author obtains the implication and basic theory of farmland property rights, and further summarizes three kinds of utility in farmland property rights, including resource configuration utility, stability utility, and social security utility;Second: the transition route of farmland property rights in our country. Resting on clue of the transition route of farmland property rights in our country, the author analyzes the characters in kinds of farmland property rights and the condition of utility one after another, and clarifies the regime arrangement of the houshold contract responsibility system;Third: analyzing genetic issues and the reason of issues in farmland property rights of our country currently. The author emphasis genetic issues and the reason of issues in the houshold contract responsibility system currently, and finds three reasons: the absence in subject of ownership, the shortage in contents of property rights and the contortion in structure of property rights;Fourth: expounding detailed countermeasures to farmland property rights of our country. Through depicting four kinds of practical innovation, the author excavates achieving conditions, advantages and disadvantages, finally, obtains three kinds of detailed countermeasures: one is clarifying the subject of ownership under farmland owned by collectives; the other is replenishing the contents of property rights, and finalizing the eternal land operation; at last, the countermeasure is adjusting the structure of property rights, constructing reasonable and regular mechanism of land circulation.更多还原
