【摘要】 知识经济时代,知识产权以前所未有的地位在社会发展中担任重要的角色。软件产业作为信息产业的重要支柱,其知识产权保护与管理在软件企业的技术创新、转移和扩散整个过程中已处于核心地位,成为软件企业谋求竞争优势的现实选择。软件开发难度大,创新成本高,更新换代快,传播成本低,极易被他人复制、盗版,而且整个过程迅速隐蔽的特性,使得盗版软件充斥市场,给软件开发企业带来巨大损失。盗版软件的存在打击了软件开发商的积极性,破坏了我国软件行业的投资环境,尽管软件企业一直在对盗版现象进行打击,但是效果不是很理想,因此如何有效保护和管理软件知识产权显得十分重要。本文主要是站在软件企业的角度,对软件知识产权保护与管理策略展开研究。首先,从宏观角度出发,结合软件特点,利用经济博弈论分析了保护过程中所涉及的政府、软件厂商之间的关系,通过“纳什均衡”“有限理性”等博弈理论分析正版软件厂商在打击盗版过程中的行为选择,探讨如何能够通过政府与正版厂商、各正版厂商间的合作打击盗版,并对如何更有效保护软件知识产权提出建议。接着从微观角度,探讨了软件企业如何进行内部知识产权管理。有效管理的前提是正确评估软件知识产权价值,只有认识到知识产权作为一种重要的无形资产的潜在价值,才能提高企业知识产权管理意识,加强管理。由于知识产权的价值评估具有较大的不确定性和模糊性,目前的价值评估方法----收益现值法、成本法和现行市场法在处理不确定性问题上有很大弊端,文章建立了模糊评价模型对其进行评估,以便企业客观的评估其软件知识产权价值。然后在评估的基础上,论文的第4章更进一步从企业内部组织建设及知识产权人才培养的角度,分析软件企业知识产权管理。文章最后提出建设性的保护与管理策略建议。更多还原

【Abstract】 In the knowledge economy time, intellectual property plays the most essential role ever in history in the social development. Software industry as an important part of IT industry, to seek its development by promoting technological innovation and more fierce competition in the field of intellectual property has become a prominent feature of today’s market competition. Software is hard to R&D, expensive to innovate, short period to update. However, it costs little to spread, can be copied、pirated easily, and the whole process is covert. The existing of pirated software has frustrated the legal company’s enthusiasm for innovation, and destroyed the investment environment. Although software companies have hit the pirated phenomenon all the time, still have little effect, so it’s important to protect and manage software intellectual property efficiently.This paper stands in the software enterprise primarily, aiming to research software intelligent property protection and management strategy. Firstly, from the macro-aspect, based on the software’s characters, discusses the relationship of government and the companies by "Nash Equilibrium"" limited rational Game" etc., points out how to hit the pirate through cooperation between legal software companies. We find that the key of protection depends on the behavior of government and the legal software company, and give them some useful advice. Then from the micro-aspect, the paper discusses how to manage intellectual property. Appraisal is the base of management, only if the companies realized the value of their intellectual property, could they attach more importance to it, and do more to manage it. As intangible asset, intellectual property has great value. There are many uncertainty and illegibility during appraisal, the appraisal methods used now have some disadvantage,so in this paper, Fuzzy Multiple Goals Decision-making Method Model is applied to appraise intellectual property for helping the companies appraise its value properly. In Part 4, the paper analyses intellectual property management by building intellectual property organization and cultivating experts related.
