【摘要】 弱势群体的存在是一个不容忽视的社会问题。弱势群体作为一个特殊的群体,他们的权利受到弱化。社会中的不平等造成了弱势群体权利的弱势,给社会的稳定带来了很大的隐患。要实现法律对弱势群体权利的保护,就应当在承认这种特殊性的基础上进行一个倾斜性的制度设计和采取特别的救济措施来实现弱势群体的增权。本文一共分为五个部分,第一个部分是引言,在这部分中对选题的意义和国内外研究现状进行了简单的介绍。第二个部分是弱势群体的概念界定,首先介绍国内一些学者对弱势群体概念的定义,然后分析弱势群体的特征和产生的原因。第三部分阐述了弱势群体权利在当前社会条件下遭到弱化的表现是地位弱势、机会弱势、对待方式弱势三个方面,并对产生弱势群体的根源进行了探讨。第四部分提出立法是解决弱势群体权利保护的根本所在,并且立法针对弱势群体需要在普遍性与特殊性之间找到一个平衡,以此为基础提出了保护弱势群体的一些基本原则。如平等原则,倾斜保护原则和合理有度原则。并且解析了如何从制度和理念层面保护弱势群体权利。包括树立一种为弱势群体增权的意识,通过宪法司法化的手段保护弱势群体权利,制订倾斜保护制度和完善社会保障制度等。最后一部分对弱势群体在司法救济、行政救济和法律援助方面提出一些具体的措施。更多还原

Realize the law to the vulnerable group right protection,Must acknowledge in this kind of particular foundation carries on an inclining system to design and takes the special relief measure to realize the vulnerable group to increase the power. This article altogether divides into five parts,The first part is an introduction, has carried on the simple introduction in this part to the selected topic significance and the domestic and foreign research present situation.The second part is the vulnerable group concept limits,First introduces the domestic some scholars to the vulnerable group concept definition,Then analysis vulnerable group characteristic and produces reason. The third part elaborated the Vulnerable group right in the current social condition next time to the attenuated performance is the status weak trend, the opportunity weak trend, the treatment way weak trend three aspects, and the pair process Vulnerable group root has carried on the discussion. The fourth part proposed the legislation is solves the Vulnerable group right protection basis to be at .And legislates in view of the Vulnerable group needs found a balance between the universality and the particularity, proposed protection weak trend community’s some basic principles take this as the foundation.
