网络环境下著作权侵权探讨

【摘要】 网络环境不仅专指数字通信网，还包括具有联网功能的计算机及相关设备、可进行网络传播的数字化资源、信息资源的制作者、网络运营与服务提供者以及网络用户。全球网络环境的形成，对传统著作权的法律特征和法律内容都提出了挑战。 由于国内和国际形势的变化，以及网络环境的冲击，我国政府对1990年的著作权法进行了修改。新著作权法对原著作权法的改动分为5种情况：一是删除条款，二是增补新条款，三是扩充已有条款的内容，四是修改条文措辞，五是调整条款顺序。新著作权法扩大了著作权的主体和客体，增加了著作权人的权利，完善了邻接权保护，新增了著作权集体管理制度和转让制度，加大了侵权打击力度，规范了执法措施，但没有明确对新技术作品著作权的保护，另外对公众合理使用作品的权益也有所损害。 在网络环境下，著作权侵权行为主要有8种，既有直接侵权行为，也有间接侵权行为。行为人的行为直接侵犯了著作权，必须承担法律规定的侵权责任，包括民事责任、行政责任和刑事责任。网络服务提供者间接侵犯著作权是否应当承担责任，须根据具体情况，依据法律规定予以认定。 网络信息活动者应该提高保护自有著作权的意识，利用著作权声明和技术措施来预防他人侵犯自己的权益。作为网络信息活动主体构成的网站必须重视依法经营，加强管理，才能预防侵犯他人的著作权，以免陷入著作权纠纷。 在极其复杂的全球网络环境中，网络信息活动者不可能完全避免著作权纠纷。收到侵权指控后，网络信息活动者可利用被控作品的著作权问题、通知与反通知制度抗辩，也可以利用侵权行为的构成要件(不法行为、损害事实、主观过错、因果关系)抗辩，还可以利用著作权权利限制(合理使用、法定许可转载、默认许可)抗辩，以维护自己的利益。更多还原

【Abstract】 Web environment is consisted of not only the digital communicating net,but also the computator and the equipment that can connect net, the digital resource and its creators, the corporations that offer network’s service and the user. Web environment has come into being. It challenges the features and contents of traditional copyright law.Owing to the transformation of national situation, the transformation of international situation and the impact of web environment, our country modifys old Copyright Law.Other than old Copyright Law, New Copyright Law deletes some items,adds new items,adds the contents of old items, modifys diction and adjusts the order of items.In New Copyright Law,the types of copyright’s owner, the types of opus and the contents of copyright are added,the organization’s management system appears,the punishment of infringement becomes powerful, and the means of punishment adds. But New Copyright Law doesn’t protect some new opus,and it reduces the contents of fair use,so it impairs the benefit of people.In web environment,the action of copyright’s infringement has 8 types, people may invade copyright directly or indirectly.If people invade copyright directly,he must undertake the duty of infringement.If the corporation invade copyright indirectly,it is decided by law if the corporation undertake the duty of infringement or not.People must elevate the awareness of protecting copyright.They can use the statement of copyright and some technical means to protect own copyright.The manager of website must administer lawfully, so that they don’t invade other’s copyright.In web environment,people can’t avoid the case of copyright totally.If they receive the lawsuit of copyright,they can use some means to argue,such as the copyright of opus, the system of announcement, the factors of infringement and the restriction of copyright.更多还原
