【摘要】 从20世纪80年代以来,随着我国市场经济的发展和城市化进程的加快,大批农民涌向城市,到目前为止,进城务工的农民已经突破一亿。农民进城务工经商,加快了城市各项产业和事业的发展,方便了城市居民的生活,为城市创造了财富和税收,促进了城市经济和社会的繁荣。作为我国的普通公民,农民工享有宪法授予的、不可剥夺的社会保障权利。从社会保障立法思想的历史发展来看,社会保障权是人权的衍生物,已经成为各国所承认的基本人权,农民工理应成为社会保障的受益主体。从社会连带的角度来看,社会中的人们必须相互依赖,作为个体的农民工遭遇的困难不仅仅是某个人的困难,更是全社会的困难。从社会利益平衡的角度来看,农民工为社会经济发展做出了诸多牺牲,在生存、发展遭到个人不可抵御的风险时,他们应该得到社会安全网的保护。但是,由于思想观念、法律制度、城乡二元结构等多方面的原因,这样一个人数众多的团体既无法享受来自土地的保障,又得不到城市社会保障的温暖,陷入了农村与城市的边缘地带。他们在就业机会、劳动安全、工资收入、教育等各方面与城市居民有着较大的差别,特别是在社会保障方面与城镇居民相距甚远。农民工群体一直处于社会保障权利的缺失状态,对社会稳定、经济发展产生了极为不利的影响。抛开固有观念的束缚,从新的角度重新考察农民工,可发现农民工已经成为新兴产业工人。农民工社会保障权利缺失的现状,折射出我国现有决策机制、法律制度、户籍制度等诸多制度安排对农民工社会保障权实现的阻碍。探求社会保障权的理论和依据,可以发现农民工群体享有不可剥夺的社会保障权,他们的社会保障权有其固有的内涵与特点,与城市工人的社会保障权有一定区别。根据我国当前实际情况,探索完善社会保障立法和其他相关制度的路径,以保障农民工的社会保障权。更多还原

【Abstract】 Since the 1980’s, with the development of our market economy and rapid growth of urbanization, a lot of farmers burst into the city, the farmers, going to the city to find jobs, have exceeded 100 million. Farmers, going to city to work, speed up the development of town service industry, make the life of urban residents convenience, create fortune and revenue for the city and accelerate the prosperity of economy and society.As a common citizen, the immigrant peasants have the undeprivable right of social security given by the Constitution. From the development of society security legislation thought, social security right is the ramification of human right admitted by every country. The immigrant peasants should be the lucre main body of social security. From the point of social benefit balance, the immigrant peasants have made a lot of sacrifice for the economy development. When they meet the unresistant risks on their survival and development, they should be protected by the social security net. However, for the reason of thoughts, law system and dualistic structure of town and country, such a big group can’t enjoy the guarantee from not only the land but also the town, and it is stranded in the edge area between country and city. There are big differences between rural citizens and urban citizens on employment opportunities, working security, payment and education, etc., especially on social security.The immigr ant peasants have been lack of the social security right, which made negative effects on social stability and economy development. From a new aspect, the author analyzes the immigrant peasants identity as the rising industry workers, reveals the main causes of the immigrant peasants’lackness of social security right through the actuality of their social security, expounds the law gist and further theorical gist enjoyed by this group, analyzes the connotations and characteristics of the immigrant peasants’social security right and the author suggests that all systems should be perfected to guarantee the immigrant peasants’social security right according to our actual situation.更多还原
