【摘要】 目前大学生考试违规现象严重，因此由于考试违规而受处分的学生也不在少数，而对大学生考试违规处理由于诸多因素的影响而存在不少问题的现实，以法学、教育学、教育心理学等理论为指导，运用文献法、调查法、归纳法等研究方法，通过对学校内部考试规章、考场记录、大学生考试违规处理个案和现实案例的调查，从法律的视角筛选出大学生考试违规处理中存在的法律问题，并作深入探讨，提出大学生考试违规处理的法治化途径。 全文共分四章，第一章为文献综述。主要从考试作弊的历史与现状、考试违规处理的法律依据的历史与现状、以及学校处理考试违规学生的法律关系三个方面，对他人的研究进行了较为翔实的概述，并提出了问题，探明拓展研究的空间；第二章为实证调查。采用调查法和庭审旁听的方法对大学生考试违规处理展开调查，并对调查结果进行整理、归纳与分析；第三章为法律检视。运用法学理论针对大学生考试违规处理的法规依据、程序、权利救济以及教育性原则的贯彻四个方面进行深入探讨；第四章为法治途径。从立法、普法、监督、权利救济四个层面提出一系列规范大学生考试违规处理的具体措施。更多还原

【Abstract】 Considering the more and more serious exam-violating-regulation phenomena among the students and the increasing number of the students who have been punished for their violation of exam regulations, considering the punishment of the students who have violated exam regulations, this paper puts forth a law-governed way to deal with students’ violating exam regulations after screening the problems in the treatment of students violating exam regulation from the point of view of law and discussing them profoundly, is guided by science of law and discussion them profoundly, which is guided by science of law, education and educational psychology, and which is done with such methods as those of literature, investigation and induction in addition to the investigation of exam regulations and exam-site recording in universities and colleges ,of individual cases of treatment of students who violate exam regulations.The whole paper consists of 4 chapters. Chapter 1 is the summary of literature, outlining the former scholars’ research mainly from the history and present situation, the history and present situation of law basis in treating violation of exam regulations and the legal relationship for schools to treat the students violating them; putting forth the authors doubt about the previous research and exploring the space for the further research. Chapter 2 is the positive investigation. In this chapter the author has investigated the treatment of the students’ violation of exam regulations by taking investigation method and court trial audit method, and then sorts out, induces and analyses the investigation results. Chapter 3 is inspection of law, profoundly probing into the law basis, the programme, the right relief and the carrying out of educational principle in treating students who have violated exam regulations by using theory of science of law. Chapter 4 is about the law methods, in which the author puts forth series of practical ways to treat students’ violation of exam regulation which concern the legislature, law spreading, supervision and right relief.更多还原
