【摘要】 近年来转化犯已经成为我国刑法理论研究中的一个热点问题,我国刑法学界对于与转化犯相关的一些重点条文的研究已经比较深入,但对转化犯这一犯罪形态的基础理论的研究却不够深入,这种不足尤其体现在对转化犯概念的研究中。各论者往往基于对这一问题理解角度的不同,而得出各不相同的转化犯的概念。因为对转化犯的概念有着诸多不同的界定,就直接导致了转化犯理论研究的混乱。但要得出一个准确的转化犯概念,就需要我们对这一概念所包含的各部分内容进行深入的分析,如转化前与转化后的行为性质问题、转化条件问题、基本罪与转化罪的关系问题等。本文在前人研究的基础上,立足于刑法的具体规定,对界定转化犯概念所必须解决的前提性问题进行一次较为深入的阐述,进而得出一个相对而言更为合理的转化犯的概念。更多还原

【Abstract】 The concept of translation crime has been defined and illustrated in the criminal legislation of both at home and abroad. But the concept of transformation crime is created by educational circles in criminal law of our country, what it point is thus a kind of law phenomenon, namely that behavior begins the implement crime, converting into another kind of commit crime because took place the legal origin of matter, and press another offense to sentence the punishment. There are definite articles and clauses on the regulation of translation crime in both the Criminal Law of 1979 and the Criminal Law of 1997 of our country. Legal circle of our country have generally accepted the name and legislative reality of translation crime and reached some common views after wide discussion on the theory of translation crime As a new criminal form, the study of transformation crime is still not mature enough. if have no an accurate confidence to the basic concept of this problem, so it will be very difficult to go forward to go thorough the research .This kind of phenomenon is obvious in the theory of transformation crime .As known to all of us, the emergence that converts to make this theories comes from the scholar who make a certain lawmaking form generalization of the criminal law, rather than the abstract to the theories of the crime appearance of the actuality, so come to a concrete decision that must be have a foothold in the penal code ruling to this research of the theories. But the different scholar proceed from the different comprehension toward the penal code ruling, getting the concept that different conversion make.
