【摘要】 环境行政不作为目前已经成为我国环境行政执法中的一个突出问题。随着国家对环境保护力度的加大,环境行政不作为便成为了社会关注的焦点问题。环境行政不作为具有较大的危害性,而客观上又有一定隐蔽性。因此,在我国环境行政不作为受关注的程度较少,缺乏相关的系统理论研究,不能适应目前环保实践的需要。因而,非常有必要对环境行政不作为进行探讨研究。其研究的结果对规范环境行政主体的环境监督管理行为,更好的促使环保领域的依法行政、实现可持续性发展有着很大的实际应用价值。 本文通过对环境行政不作为基本理论问题的探讨,明晰了环境行政不作为的实质特点;通过笔者的实际调查与潜心研究,对环境行政不作为的表现及形成原因进行了深入的分析;本文还结合比较了我国与国外相对完善的规制环境行政不作为的相关理论,总结出其可以借鉴的先进经验;最后联系我国的实际,针对环境行政不作为的规制与救济制度的欠缺状况,提出了完善环境行政不作为的事前法律规范、健全事后救济的司法审奁制度和行政赔偿制度,加强环境管理的内外监督机制等方法,来健全我国对环境行政不作为的规制与救济的建议。笔者期望通过这些手段的综合运用与实施,达到进一步强化环境行政主体监督管理的目的,使环境行政主体严格责任、切实履行其法定的环境监管义务,有效的遏制环境行政不作为的发生。更多还原

【Abstract】 Nowadays environmental administrative omission has become an outstanding problem in our executing environmental administrative law .Following thrength of the environmental protection of our country ,the environmental administrative omission has turned into a focus problem in our society. Environmental administrative omission has stronger harmfulness ,and objectly , it also has some concealed character .Therefore,it was paid less attention to environmental administrative omission in our country ,at the same time it was short of interrelated systematic study , which can’t adapt to the needs of the environmental protection now. Consequently, it is essential to study the environmental administrative omission .The result of the study will admonish the environmental supervisory behavior of the environmental administrative main body ,it will be benefital to law in rule on environmental domain ,and it also has useful practical value worth to sustained development.Through discussion on the basic theorial problems of environmental administrative omission ,the paper explicate the essential characters of the environmental administrative omission clearly;The paper deeply analyzes the manifestations and reasons after the author’s investigation and studying with great concentration;The paper compare the theories of our country with other countries which admonish environmental administrative omission , concludes their advanced experiences;Finally ,to relate with our country’s practice , in the light of deficient condition which admonish and receive the environmental administrative omission of our country ,the paper pose to perfect the legal standards of environmental administrative omission, threngthen judicature and administrative compensate, reinforce the supervior of environmental administrative and so on ,to threngthen admonishing and relieving the environmental administrative omission .The author expect to utilize and carry out these methods ,arrive to the purpose which strengthen supervisor management of environmental administrative main body ,expect the environmental administrative main body will enforce liabilities, perform their legal environmental supervisor liabilities honestly .restrain the happening of environmental administrative omission effectually .更多还原
