【摘要】 土地作为最基本的生产要素,与农民的生产和生活最为密切。理论上,土地作为生产要素,只体现为单一的生产功能,可以依据市场的价格信号进行最优配置。但实际上,土地不仅作为农业的基本生产资料,还发挥社会保障的功能,而且是土地的主要功能之一。从土地社会保障功能的角度研究农村土地制度,可以为研究我国农地制度提供一个新的认识视角和分析框架,对推进土地制度改革和完善,有效配置和合理利用农村土地资源有非常重要的意义。基于此目的,本文将对土地社会保障功能的表现及其影响因素,土地保障功能的特点、结构和作用,土地保障能力等进行系统分析和论述,试图寻找一种改革和完善现行土地制度的路径,以实现土地的合理配置和利用。全文内容共分六个部分:第一部分,导论。包括本研究问题的提出、研究综述、研究内容和创新与不足。第二部分,阐述土地社会保障功能的概念及与其相关的农村社会保障和土地制度相关概念和发展,作为本研究基础。第三部分,描述现阶段农地被赋予社会保障功能的原因。该部分研究了土地被赋予社会保障功能的决定因素。结论是土地社会保障功能是在城乡二元结构下,农村社会保障体系未能有效建立和中国传统思想文化环境中形成的;它受人均土地资源占有量和农民家庭收入结构的影响。土地集体所有制和家庭承包经营制度则是土地具有保障功能的内在因素。第四部分,对土地社会保障功能的特征和结构(包括保障主体、客体和内容)进行定性分析。第五部分,实证分析土地对农民的实际保障能力,特别是对农民在基本生活、养老、医疗方面的保障能力。结果表明,尽管农地更多地表现为社会保障功能,但对于占相当大比重的农户家庭特别是贫困地区和单纯依靠土地获得家庭收入的农户,土地无法提供充足的保障。进而对土地社会保障功能从正反两方面进行理论评价和总结。第六部分,在分析土地社会保障功能发展趋势基础上,提出土地制度更多还原

【Abstract】 Land is the basic factor of production. The relationship between the land and farmers is mostly close. Theoretically, as the factor of production, the land only effects as the single productive function, which could optimum allocation according to the price signals of the market. In fact, besides existed as the basic means of agricultural production, the land also has functions as the social security, which is one of the main functions of the land. From this angle, the research of land system can supply a new angle of view and analysis frame to enhance the regulation reform and improvement. It is also very significant to guide the effective allocation and proper utilization of the rural land resources. To achieve this goal, the article will analyze and state the reflection and the influence elements and the feature, structure and capacity of the social security function of land. It’s the try to search for a way to reform and improve the present land system to achieve the proper arrangement and utilization of the land.There are six parts in the article:The first part is introduction, which includes bringing forward the question, summarize, content, innovation and shortage of the study.The second part gives the definition of the social security function of land, and the definition and development of the country social security and the land system as the base of study.The third part states the interior and exterior influential factor of the social security function of land as the reasons.
