【摘要】 当今世界,知识向经济转换的巨大力量已不容忽视。与知识经济密切相关的专利制度,对于谋求经济的更快增长的21世纪的中国有着特殊的重要意义。而外观设计专利保护制度,则更是由于其本身对纯技术含量的要求并不像发明和实用新型那样苛刻的特点,而更适应我国的现实国情。外观设计授权条件是外观设计专利制度中的核心内容,这种核心地位主要是该专利制度的特点决定的。由于在我国的专利法制度中,外观专利仅通过初步审查合格,即可获得授权;因而,如果在授权条件理论的具体适用中存在较多分歧,那么大多数外观设计专利就会处于不稳定的状况。本文就试图通过对外观设计授权条件的研究,为促进我国的专利保护工作的发展做出努力。笔者翻阅了大量论述相关问题的文献和典型案例,并结合自己的思考,对相关要点问题进行了逐一论述,并给出了认为可行的参考标准。本文在概述外观设计授权条件的基础上,着重针对外观设计的适用过程中最为重要的——“与已公开的外观设计不相同和不相近似”这一授权条件中的,对判断客体的把握、判断视角、判断方式的选择与应用以及相关的证据采信问题这几个方面进行了逐一论述,并穿插相关案例进行讨论,最后给出了笔者认为较为合适的具体标准。同时,外观设计的授权与法院的侵权判定是外观设计权利救济程序中紧密相连的两个步骤,但是,授权条件在适用于法院的侵权判定的过程中却有一些差异之处,笔者针对这些差异点进行了着重分析,以求为授权条件的理论和实践的进一步完善提供对比和借鉴。最后,笔者还针对,在外观设计的授权条件的适用中,逐步出现的一系列新的热点问题进行讨论,提出了自己的见解。本文主要引用了大量案例,通过实证分析的方式探讨问题。同时,本文针对外观设计专利的“与已公开的外观设计不相同和不相近似”授权条件中的一系列问题进行了较为系统的具体论述,并尝试着提出了解决各问题的具体标准。更多还原

【Abstract】 Compared with other parts of the patent system,the design system is moremeaningful to nowadays China.Because it doesn’t need much technologicalcontents,and also it can help China to develop its economy rapidly.In the design system,permission conditions is the most important part. Accordingto china’s patent law,a design can be authorized just after the preliminaryexamination.So if the research on the permission conditions is not abundant orwell-rounded,most design patents will be unstable.And this will be a threaten to thestability of the economic development.According to the above reasons, in this paper,the wrier was trying to do someresearch on the permission conditions of the design patents to make somecontribution .In the permission conditions, the evaluation of the identicalness orsimilarity of a design patent and a prior design has always been the key.The writerdiscussed around the key content in such following areas:the application of thepermission conditions,the relationship between the preliminary examination and theinvalidation examination and some related hot issues.And the part of the applicationof the permission conditions contains:the qualitative analysis of the evaluation,thejudgementer,the judgemented object and different principles of observingdetermination.In the paper,the writer quoted a lot of cases in the preliminary examinationprocess and the patent invalidation process.At the end of each issue beingdiscussed,the writer gave suggestions and specific standards.In all,the paper mainly analysises the evaluation of the identicalness or similarityof a design patent, the key of the permission conditions .更多还原
