【摘要】 森林生态效益补偿制度是行政补偿制度的一种具体形式,在我国是一项崭新的法律制度。它是指国家基于保护生态环境的社会公共利益的需要,对用于提供生态效益的森林合法地采取禁伐限伐措施,致使经营生态公益林的公民、法人或其他社会组织的合法权益遭受特别损害,依保障人权、利益平衡(公平负担)即法治政府原则,对遭此损害的相对人给予补偿的法律制度。作为一项法律制度,它体现一定的价值取向和价值观点,它具有人权、效益、正义、秩序等价值。在实践过程中,森林生态效益补偿制度应从林农生存状况实际情况出发,对其进行补偿,以保证其基本生活;从而充分实现该制度的社会作用,体现调整利益、保障权利、建构和谐社会等功能。森林生态效益补偿制度的生命在于其价值和功能的实现。而该制度要真正落到实处,使之从纸上的法变为现实生活中的法,还需要健全与完善与之相关的法律制度。更多还原

【Abstract】 Compensation system of forest ecological benefit is a kind of concrete form of administration compensation system. It is a new legal system in our country. It is a legal system that in the need of the public interests of protecting ecological environment, country compensate the damaged people in the light of protecting human rights and interests balance principle, when its’ behaviors of forbidding or limiting cutting trees bring about damages to those people who manage the ecological forest. As a legal system, it reflects certain value orientation and value view. It has such concrete contents as human rights, benefit, justice, order, etc. Forest ecological benefit compensation system should compensate the cultivators according to their practical conditions so as to ensure their basic lives, which can fully realize the social functions of this system, and reflect those functions such as adjusting interests, ensuring rights, constructing harmonious society, etc. The key of forest ecological benefit compensation system lies in realizing its values and functions. Also, we should complete and perfect the relevant legal systems in order to make it a reality law from the law in the paper.更多还原
