【摘要】 本文论述了建筑工程施工合同中的索赔管理,通过理论联系实际,结合国际惯例和国内情况对监理工程师在索赔管理中所处的地位以及在索赔处理和解决过程中的工作和应当遵循的原则、立场等方面进行探讨,并针对目前我国建筑工程施工合同索赔管理中存在的不足,提出了关于加快完善建筑工程施工合同索赔管理和监理工程师多角度加强索赔管理,实现预控目的的几点思考和建议。 全文分为五个部分。第一部分是问题的提出,针对我国现阶段在索赔管理的认识和运用上存在的不足,分别从业主、承包商和监理工程师三个方面分析加强建筑工程施工合同索赔管理的必要性。第二部分是概述,对索赔作了系统性的阐述。第三部分是本文的重点,从不同的角度对建筑工程施工合同索赔管理进行论述。在这一部分,文章首先从国际惯例出发分析FIDIC合同条件下的索赔管理,进而通过理论和实际相结合的方式,着重对监理工程师在索赔管理中的工作和公正性以及在索赔管理中应遵循的原则、立场等方面进行论述分析,并结合我国国情探讨监理工程师对索赔事件的处理。第四部分是针对建筑工程施工索赔管理工作,完善索赔管理工作特别是监理工程师在合同索赔中如何多角度加强管理,实现预控目的要着重的加强的几个侧重面。第五部分是根据工程中的实践经验,参照国内外施工索赔管理的经验,提出了在建筑工程施工合同索赔管理工作中应特别注意的几点参考建议。更多还原

【Abstract】 The research work of the thesis focuses on counterclaim management of project construction contract. Base on theories and practices of counterclaim management, combined with international tradition and national condition, the status of supervisor engineer in counterclaim management, the work content are discussed. Because of the insufficiency of counterclaim management, the work content of counterclaim management, the principle and standpoint of counterclaim management are discussed. Because of the insufficiency of counterclaim management of project construction contract in our country, the thesis puts forward some thoughts and advice on better counterclaim management of project construction contract and reinforcing counterclaim management by supervisor engineer from multi-point in order to realize scheduled objects.The thesis includes five parts. The first part puts forward the question. In allusion to the insufficiency of cognitions and exercise of counterclaim management in our country, the requirement of improving counterclaim management of project construction contract from the point of project owner, contractor and supervisor engineer is analyzed. The second part is a systematic summary of counterclaim. The third part is the key content of the thesis. Counterclaim management of project construction contract is discussed from several points. Firstly, Counterclaim management under FIDIC contract is discussed based-on international tradition. Then by the way of integrating theories and practices, the work of supervisor engineer in counterclaim management, the fairness, the principle and standpoint of counterclaim management are discussed detailed. The fourth part focuses on the work of counterclaim management of project construction contract, thoughts and advice on better counterclaim management of project construction contract and reinforcing counterclaim management by supervisor engineer from multi-point in order to realize scheduled objects are discussed detailed. In the fifth part, based on the practice of project management and counterclaim management internationally and in our country, some special advises of counterclaim management of project construction contract are put forward.更多还原
