【摘要】 耕地是人类生存和社会经济发展的基础。耕地是农业的根本,是人们赖以生存和发展的基本资源,所以又称耕地资源。 最近几年,耕地面积急速下降,粮食减产惊人,给国家的粮食安全带来隐患。究其原因,保护耕地资源的相关法律制度存在诸多缺陷。因此,完善保护耕地资源的法律制度是一项十分紧迫的任务。由于行政法手段具有强制性和宏观性,在保护耕地资源方面具有无比的优越性,本文重点探讨如何利用行政法的手段保护耕地资源。 从这一思路出发,第一部分引言,主要是研究的背景、目的及意义,研究现状,研究思路及写作重点。第二部分正文,分三个章节: 第一章,从我国目前的耕地资源的现状说起,指出我我的耕地资源面临严重的问题,并分析我国耕地问题存在的主要原因。耕地资源流失致使生态环境恶化,影响我国的粮食安全和带来社会动荡。耕地资源破坏的原因主要是我国对耕地资源的开发利用没有很好的进行法律规制,导致对耕地资源的滥用。第二章,分析我国目前保护耕地行政法律制度的现状,指出其主要缺陷,以便提出完善途径。我国对耕地资源保护的立法、执法和法律救济都存在不少问题。如在耕地资源行政管理立法中,耕地资源用途管制法律制度、耕地资源总量动态平衡法律制度、基本农田保护制度和耕地征用法律制度等都存在许多问题。第三章,探讨如何完善我国耕地保护行政法制度。耕地的行政法保护主要是完善耕地保护的若干行政法律制度。这些法律制度主要足:耕地保护行政组织法律制度、耕地保护行政规划法律制度、耕地保护行政检查制度、耕地保护行政处罚制度、耕地征用法律制度、耕地流转行政指导法律制度等。文章的最后部分是结束语。更多还原

【Abstract】 The cultivated land is the material base of mankind’s existence and social-economic development.However, the quantity and quality of cultivated land descend quickly, the output of grain is reducing astonishingly, and the grain per unit area yield is also pacing up and down.Investigates its reason, protects the farming resources the related legal system not to be imperfect, has many flaws. Therefore, the consummation, the perfect protection farming resources legal system is an extremely urgent duty. Because the administrative law method has compulsory, has the incomparable superiority in the protection farming resources aspect, this article discusses on using the administrative law the method protection farming resources.Embarks from this mentality, the first part of introduction, mainly is the research background, the goal and the significance, the research present situation, the research mentality and writing key. The second part of main text is divided three chapters:First chapter, mentions from our country at present farming resources present situation, points out our country the farming resources faced with the stern question, and analyzes the main reason which our country farming question exists. The farming resources drain cause the ecological environment to worsen, affect the grain safe and bring the society to beturbulent. The reason of farming resources destruction mainly is that the humanity hasn’t carried on the legal rules and regulations to the farming resources development, causes to farming resources abusing. Second chapter, analyzes the present situation of country protecting the farming administration law system, and refers to its main flaw, in order to propose the perfect way. Our country to the farming resources conservation legislation, the law enforcement and the legal relief all has many problems. Like in the fanning resources administration legislation, the farming resources control law system, the cultivated land resources total quantity dynamical equilibrium law system, the basic farmland protection system and the cultivated land takes over for using the legal system and so on to have many problems. Third chapter discusses the consummating of farming administrative law protection system. The farming resources administrative law protection mainly consummates the fanning resources conservation certain administrative law system. These legal systems mainly are: The protection farming administration organization law system, the cultivated land administration plan law system, the cultivated land administrative inspection system and so on.
