民国时期民法法典化研究

【摘要】 民国时期是民法法典化发展的一个非常重要和微妙的时期,加强对这一时期民法法典化的研究,不仅有利于我们进一步理解当时的法治状况,而且可以给我们制定新的民法典提供历史的知识资源,有助于我们以史为鉴,更好地推进我们当今民法法典化的进程。要研究民法法典化的问题,首先必须廓清民法法典化的概念,明白民法法典化并不仅仅是一个立法的行为,它并不等同于法典编纂。民国时期民法法典化有其深刻的社会历史背景,正是诸多的社会因素促动了当时民法的发展。在这一时期,有很多问题值得关注和研究。特别是几个主要的问题:民法法典化的指导思想问题、民法法典化的本位问题、民法法典化的模式选择问题、民法法典化的主体和民事习惯在民法法典化中的地位等。对这些问题的探讨,无疑将深化我们对于民国时期民法法典化的认识。客观上讲,民国时期民法法典化到了较高的水平,但由于历史条件的限制,注定了此时的民法法典化更多地停留于形式上,它不可避免地存在很多问题,需要我们做出公正的历史检讨。但不管怎样,民国时期的民法法典化还是给了我们很多启示。更多还原

【Abstract】 It is very essential and useful for us to research the course of codification of civil law in the Republic of China era which is a very important period in the history of codification of civil law in China. The article discusses the codification of civil law in the Republic of China era, so as not only to know about the situation of legal system and gain the valuable history resources, but to benefit the practice of construction of contemporary. Different from compilation of civil code, codification of civil law is not only an act of legislation. The codification of civil law in the Republic of China era developed on its own historical background and many social factors helped to bring about the civil law. Many problems are worth paying more attention, such as the guiding principle of the codification of civil law, the standard of the codification of civil law, the mode of the civil code, the subject of the codification of civil law, the situation of civil custom. It can deepen the knowledge of the codification of civil law in the Republic of China era to solve the above-mentioned problems. Objectively speaking, the codification of civil law in the Republic of China era makes more progress and achieves a high standard, especially in the form, but it is inevitable that there are some defects in the process of the codification of civil law in the Republic of China era. So it is necessary to criticize objectively and impartially this history. Anyway, we can obtain much enlightening guidance which is very conductive to enact our civil code and promote the process of the codification of civil law.更多还原
