【摘要】 本文以我国民法典的起草为契机,主要探讨如何完善我国民事时效制度的问题,立足于民法基本理论,运用比较法、分析法、归纳法、历史学等方法,对我国民事时效制度的相关问题进行较为系统和深入的研究,以期为正在进行的我国民法典的编纂工作提供切实可行的立法建议。 全文共分三部分:第一部分,简要阐述民事时效制度的历史源流及世界各国的立法现状,对民事时效制度勾勒出一个宏观的轮廓,为后面的论述奠定基础。第二部分,指出我国现行民事时效制度的缺陷及带来的弊端,并分析我国民法典草案在时效制度设计上的不足。该部分着重于探讨我国民事时效制度在理论及实践中存在的问题,进而明确今后在相关立法完善过程中的任务及重点。第三部分,乃全文的核心部分,针对我国现行时效制度的弊端及民法典草案立法设计的不足,在借鉴外国传统立法例及最新制度设计的前提下,通过理论论证和可行性分析等途径,提出完善我国民事时效制度的立法建议,并做出详细的制度设计。更多还原

【Abstract】 While China Civil Code is being drafted out, this dissertation discusses how to perfect the domestic Civil Prescription System. Based on the basic civil law theory, this dissertation tends to systematically and deeply explore the problems related to domestic Civil Prescription by comprehensive methods including analytical method, inductive method and comparative method, in order to provide feasible advices on the drafting of China Civil Code.The dissertation includes three parts. In the first part, the history and the present legislation of Civil Prescription are discussed to outline the Civil Prescription System as the basis for the following words. The second part points out the imperfection of the domestic Civil Prescription System and its limitation, and analyses the insufficiencies of the legislative design in the draft of China Civil Code. This part is focused on the problems on the judicial practice and civil law theory to further explicate the object and point in the legislative perfection. The third part is the most important, which is targeted at the imperfection of the domestic Civil Prescription System and insufficiency of the legislative design in the draft of China Civil Code. Referring to overseas prescription system legislation, the dissertation provides legislative suggestions on the perfection of domestic Civil Prescription System, as well as the detailed legislative design, by theoretical demonstration and feasibility analysis更多还原
