【摘要】 保护商业方法专利,是现代高新技术发展产生的一种内在要求,也是技术领先的国家保护本国企业利益和国际竞争力的一种措施。在我国,商业方法已经有了授予专利权的先例,但是在商业方法专利实质性条件的标准和审查方法方面还有需要完善和改进的地方。因此,寻找现有知识产权法律制度对商业方法保护的切入点和平衡点,完善商业方法专利实质性条件的标准和审查方法,是我们当前迫切需要解决的问题。 本文的研究目的在于结合美国、欧盟以及日本等国家和地区对商业方法专利保护的理论与实践,重点讨论商业方法专利的实质性条件。首先,讨论了商业方法专利的几个基本问题;其次,从各国的审查实践出发,分别对商业方法专利的实用性、新颖性和创造性条件进行分析,总结了商业方法专利实质性条件的标准和审查方法;最后,针对我国对商业方法专利保护的现状,提出了商业方法专利实质性条件审查的具体建议,并预测了今后商业方法专利保护的趋势。更多还原

【Abstract】 Protection of Business Method is not only an internal demand with the development of modern new & high technology, but also a solution for the leading countries in technology which used to protect the profits of their own enterprises and international competitiveness. In our country, although there is precedent on awarding patent to Business Method, we still have much to do on perfecting and improving censoring standard and method of substantial requirements of Business Method patent. So now the urgent problem for us is to seek the point of tangency and point of balance for Intellectual Property law system which provide protection with Business Method and the perfecting of censoring standard and method of substantial requirements of Business Method patent.The aim of this dissertation is to integrate the theories and practice in the protection of Business Method patent in the USA, the countries of European Commission and Japan and to mainly research the substantial requirements of Business Method patent. First, this paper generalize several basic problems about Business Method patent. Secondly, with the compare practice in censoring of several countries, the paper discuss the utility, novelty and inventive step conditions about Business Method patent separately, and generalize the censoring standard and method of essential conditions of Business Method patent. Finally, according to present condition of Business Method patent protection in our country, it give some own advice on censoring of substantial requirements of Business Method patent and also forecast the tendency of Business Method patent protection in future.更多还原
