【摘要】 单位成为犯罪主体代表着刑法发展的国际趋势,有着深刻的理论基础。晚近,我国刑法学界围绕单位犯罪主体的相关问题进行了较为深入的研讨,但均未取得一致的看法。本文拟对单位犯罪主体的概念、特征、结构、要件、范围和刑事责任等作系列深入地探讨,全文除了导言和结语之外共分为五大部分:单位犯罪主体变迁的脉络与制度绩效、单位犯罪主体的概念和特征、单位犯罪主体的构造、单位犯罪主体的要件与范围、单位犯罪主体的刑事责任。 第一部分主要介绍了两大法系法人犯罪主体的确立和发展历程,并重点介绍了我国单位犯罪主体的缘起和发展,印证了单位成为犯罪主体是历史发展的必然趋势。 第二部分旨在介绍单位犯罪主体的概念、特征,主要阐明了单位犯罪主体是单位,而不包括单位内负刑事责任的自然人;其具有合法性和刑事责任能力性两个基本特征。 第三部分主要剖析了单位犯罪主体的构造,对其外部形式进行了梳理,并重点解说了其内部关系中的单位与单位之下负刑事责任的自然人之间的复合关系、单位内部多个负刑事责任的自然人之间的关系。 第四部分提出了单位犯罪主体要件是单位主体要件与单位内部自然人主体要件的统一,单位主体要件体现为应具有完全法律人格。在此基础上,文章对我国单位犯罪主体的范围进行了合理的调整。 第五部分明确了单位犯罪刑事责任的本质是一体化的复合责任,在考察了中、外的单位犯罪主体刑事责任实现方式之后,对完善我国单位犯罪的刑事责任体系提出了一些中肯的建设性意见。更多还原

【Abstract】 That the unit becomes the crime subject is the international trend of criminal law in the world, which has the deep theoretical foundations. Recently, the criminal law circles of our country have researched into the issues related to the subject of unit crime, but no consensus has been reached. This thesis attempts to explore the concept, characteristics, structure and criminal responsibility of the subject of unit crime systematically and completely. Apart from the introduction and the conclusion, this thesis consists of five chapters: the skeleton of the unit crime subject flux and its system effect, the concept and characteristics of the unit crime subject, the structure of the unit crime subject, the essentials and scope of the unit crime subject and the criminal responsibility of the unit crime subject.Chapter One mainly discusses the establishment and development process of the artificial person crime subject in the two major law systems. It also offers a detailed introduction of the establishment and development of our country’s unit crime subject, which helps to prove that the unit being the crime subject has become the historical trend.Chapter Two aims to introduce the concept and characteristics of the unit crime subject. The thesis holds that the unite crime subject is only the unit and not including the natural person responsible for the criminal responsibility in the unit, which is featured by legitimacy and criminal responsibility capability.Chapter Three studies the structure of the unit crime subject, rearranges its external form and analyzes the internal compound relationship between the unit and the natural person and that between the different natural persons within the unit.Chapter Four holds that the essentials of the unit crime subject are the unity of the essentials of the unit crime subject and the essentials of the natural person in the unit and that the essentials of the unit crime subject should posses the complete legal personality. Based on this point, the thesis readjusts the scope of our country’s unit crime subject.Chapter Five makes it clear that by nature the criminal responsibility of unit crime is compound responsibilities. After reviewing the implementation methods of the criminal responsibility of unit crime subject at home and abroad, the author attempts to offer some constructive suggestions on improving the criminal responsibility system our country’s unit crime.更多还原
