【摘要】 数百年来,西方学者曾梦想把政府变成“玻璃缸里的金鱼”,清澈透明。事实上,世界上众多国家正在进行着透明政府的实践表明,透明政府是21世纪民主国家建设的一个发展方向。 党的十六大明确提出,实践全面建设小康社会的历史重任,必须进一步转变政府职能,改革管理方式,推行电子政务,提高行政效率,降低行政成本,形成行为规范、运转协调、公正透明、廉洁高效的行政管理体制。随着经济体制改革的深入,对民主政治的呼唤也越来越强烈。适应现代化建设的需要,建立高度民主,法制完备、富有效率、充满生机的社会主义政治体制,正是我国政治体制改革的长远目标,也是我国建设全面小康社会的基本要求。而实施“透明政府”这一战略选择,恰恰与我国政治体制改革的内在精神是一致的,也是政治体制改革的方向。因此,及时对透明政府进行深入系统的研究,解决相关理论问题,并提出有较强针对性和可操作性的对策,无疑是十分必要的。 本文综合运用政治学、公共行政学、行政法学等学科领域的不同研究方法,立足于国内外已有的相近领域的研究成果和资料,明确提出透明政府是在公民本位、社会本位理念指导下,在社会主义政治文明框架下,按照政务公开透明、公民参与政务活动原则建立起来的承担满足公民公务信息知情权和政务活动参与权义务的政府;其内涵包括“以人为本”的信息伦理、“循序渐进”的信息公开、“积极有序”的公民参与、“软硬结合”的制度保障。重点分析了我国透明政府建设的政治学、行政学、行政法学理论依据,即人民主权理论、公民知情权和参与权理论、治理理论、平衡论;指出WTO透明度原则的挑战、建设社会主义政治文明的必然要求、推进依法行政的必要途径、遏制腐败的治本之策更多还原

【Abstract】 For hundreds of years, the western scholar once dream of to become the " glass goldfish in the urn" to the government, pure and transparent. In fact, numerous nations are doing the transparent governmental fulfillment, which expresses the transparent government is a development direction of democratic nation in 21 centuries.16th big of administration clearly and definitely putting forward that in order to practicing completely social history in middle-class family in developments ,we must chang government working talent, reform managing way, promot electronics governmental affairs, increase administration efficiency, lower administration cost, formate behavior norm, revolve the system with coordination, fairly transparent and incorrupt efficient. Along with the economic system thorough, the call to the democracy become more and more strong. Accord to the demand of modern development ,establishing the high degree democracy, the complete legal system ,enrich efficient, alive with organic socialism, is target of our political reform, is also request of our country developing completely social basic in middle-class family. Then putting the the " transparent government" strategy , is consistent with our inside spirit of our political reform, is also a direction of political reform. Therefore, it is doubtless very .necessary for us to proceed the research of the transparent government system in time, resolve the related theories problem, and put forward the countermeasure with stronger aiming and maneuverability.Using the comprehensive methods of politics, public administration andadministrative legislation, based on the relevant studying fruits and information, this essay clearly states that a transparent government is the government like this :under the guide of citizen standard and society standard, within the frame of socialistic democracy, according to the governmental affairs transparent, citizen can participate the governmental affairs activity, the government is established to satisfy the right to know and participate. Its content includes the information ethics which "regarding the people as the root"; information disclosure gradually; positive citizen participation; the system assuring which is combination between soft and hard. The essay focuses on explaining the theoretical foundations of politics, public administration and administrative legislation, that is to say, theory of people sovereignty, theory of the right to know and participate , theory of management and theory of equilibrium ; the practical basis of the transparent government include: the challenge of WTO clarity principles; the inevitable request of people realizing the right to take charge in political and construction of socialist political civilization; the inevitable choice of pushing forward administration according to law and reforming government management methods; the measures to anti-corruption. On this basis .investigating to our country system in the transparent government in development, aiming at the present problem of transparent government developments, putting forward that we should take pertinent measures to push forward the construction of transparent government from 6 aspects on the basis of comparing and drawing lessons from our country Hong Kong, .Taiwanese region, and the United States, England, Japan, Korea...etc: enhancing the idea grows, setting up new orientation culture of transparent government; pushing forward the change of government working talent; enhancing the law rules system, construct or purchase the transparent and governmental rule of law system; enhancing the mechanism of inspect; seeking to allow to carry, perfect kit, deep turn transparent government developments; setting up the system about citizen participates, unimpeded the outlet of citizen politics participates.Finally, the essay makes the following conclusion: facing the challenge of globalization and information turn, citizen demand more disclosure and transparent,as well as government too increasingly looking for giving citizen more information and enhancing relation between government and citizen, building a kind of positive colleague in the government with the period.
