【摘要】 国有林地的流转适应了林业经营思想转变的要求,通过市场的配置,使林地资源的所有权和使用权相分离,彻底打破长期以来形成的责、权、利不统一的情况,建立起与新的林业发展思想相一致的流转制度,为国有林区的现代化经营提供了有利的支持。但是,目前由于我国国有林地流转处于起步阶段,存在着许多需要解决的障碍与矛盾,因此需要系统地对国有林地流转进行研究和分析,从而明确国有林地的具体流转形式,分析出制约国有林地流转的限制因素,并提出相应的对策。 国有林地流转是国有林地使用权的流转,是在不改变国有林地所有权和国有林地用途的前提下,将国有林地的使用权按一定的程序,以有偿的方式,由一方转让给另一方的经济行为。本文根据国有林地流转基础理论的研究,提出了国有林地流转的内涵,明确了国有林地流转所具有的特点,并在此基础上提出国有林地流转应划为商品林林地流转和公益林林地流转,并分别对这两类林地流转的目标、流转双方的确定、具体流转方式及流转程序等内容进行了深入的研究和具体的设计。然后,通过对国有林地流转实践的客观分析,本文从主观行为、客观条件和政策制订上,分别对国有林地流转的限制因素进行了深入分析和研究,明确了当前国有林地流转所面临的问题。所以,最后本文在分析制约国有林地流转限制因素的基础上,分别从规范国有林地流转的标准、方式、建立基础性制度、加强政府行为和恰当选择国有林地流转后的经营管理方式四个方面提出了相应的对策。更多还原

【Abstract】 Circulation of state-owned forestland accommodates the request of transiting the forest management idea, through the disposition of the market, which makes the ownership and use-right of forestland resource desperate, and which completely breaks the condition that the responsibility, the right and the benefit are not been united, establishes the circulation system that is same to the new forestry development idea, and offers the favorable support for the modernization management in state-owned forest zone. However, at present, because the circulation of state-owned forestland is at the beginning, has lot of obstacle and contradiction needing to be resolved, so need to research and analyze it systematically, thus to definitude its concrete circulation form, analyze the limited factors that restricts it, put forward the corresponding countermeasures.Circulation of state-owned forestland is the circulation of forestland use-right, is a kind of economic behavior on the premises of not changing the ownership and the use of state-owned forestland, which makes the use-right of state-owned forestland transfer from one side to another side according to some procedure in a paid way. This dissertation, according to the basic theory research of circulation of state-owned forestland, proposes the circulation intension of state-owned forestland, definitudes the circulation characteristic, and on the base of which proposes that the circulation of state-owned forestland should be divided into the circulation of commodity forestland and the circulation of commonweal forestland, separates to deeply research and concretely design the goal, the confirmation of both sides in circulation, concrete circulation form and circulation procedure and so on. Then through the objectively analyzing to the practice on the circulation of state-owned forestland, this dissertation separates to deeply analyze and research the limited factors of the circulation of state-owned forestland from the subjective behavior, objective condition and policy drawing, and definitudes the problems that the circulation of state-owned forestland is facing. So, finally this dissertation on the base of analyzing the limited factors of restricting the circulation of state-owned forestland, separately proposes the corresponding countermeasures form four aspects that are the standard and the form of circulation of state-owned forestland, setting up basic system, strengthening the behavior of government and appropriately choosing the management form after the circulation of state-owned forestland.更多还原
