【摘要】 产品责任作为现代化大规模生产的产物,是现代社会所必然出现的一种法律现象,在世界各国的法律理论和实践中都受到了很高程度的重视。产品责任保险是产品责任发展到一定阶段的必然结果,对保护消费者的合法利益、分散生产者和销售者经营风险均起到了重要的作用,并在世界范围内蓬勃发展。在保险发达的西方国家,由于其先进的保险理念及完善的法制建设,产品责任保险有着相对成熟的发展,从而推动了经济建设的进步。我国的产品责任法制建设相对滞后,因此,产品责任保险在我国的发展并不尽如人意,在保护消费者权益以及分散生产者风险两方面仍处于落后被动的局面。随着世界经济一体化的深入,国际产品责任的高速发展以及产品责任诉讼的日益增多,产品责任保险引起了各国的高度重视。正因如此,如何完善我国产品责任保险法律制度、保护消费者权利以及如何分散产品生产者、销售者的经营风险,是目前我国经济建设及法制建设中所必须解决的重要课题。 本文对产品责任保险法律理论进行了较为系统的研究。由于我国产品责任保险的理论研究相对落后,本文借鉴了西方发达国家关于产品责任保险的先进理论研究成果及实践经验,指出现行体制中我国产品责任保险法制中存在的问题,论述了我国加强产品责任保险的必要性,最后对如何完善我国产品责任保险法律制度提出了自己的建议。以期抛砖引玉,引起相关人士的重视,来共同发展我国产品责任保险市场和完善我国产品责任保险法律制度。更多还原

【Abstract】 As a result of modern great production, product liability inevitably becomes a law issue, to which more and more countries pay attention. With the development of the system of the product liability, product liability insurance system emerges in such developed countries as America, England. The system of the product liability is benefit to protect the legitimate rights of customers, and disperse the risk managements of producers and sellers, Therefore it gradually expands to other countries. In western countries, the system of product liability insurance became more and more perfected because of their advanced insurance theory. China now has no product liability insurance legal system, which hampers Chinese economic development. With the globalization of economy, developing of international product liability and more product liability actions, the product liability insurance became more and more important. So, erecting and perfecting our country’s legal system of product liability insurance to protect customer’s rights and disperse the risk managements of producers and sellers are an essential question in our economic construction.The thesis has made comparatively systematic research on the legal theory of product liability insurance. Because the theoretical research of the product liability insurance of our country lags behind developed countries relatively, advanced theory research results and practical experiences of west developed countries are referred to in product liability insurance. It is pointed out problems that product liability insurance has in the current system, expounded the necessity to strengthen product liability insurance, and proposed how to perfect our product liability insurance. Through presentation of the subject topic, the thesis is intended to generate and call upon the attentions and enthusiasm of those concerned, committing them to develop our product liability insurance market and perfecting its legal system.更多还原
