论物权变动的抽象原则

【摘要】 民法是国家的基本法律,调整平等主体之间的财产关系和人身关系,是社会生活的基本准则。民法规范着公民的衣食住行、生老病死以及企业的设立、经营、终止等等。老百姓怎样生活,企业怎样运作,都与民法密切相关。而物权变动模式的确立对一国民法的制定和发展意义重大。物权变动模式也越来越多的纳入中外民法学者的研究视野,因为这是一个不仅具有很高的理论价值的法理问题,而且也是一个具有很高的实践价值的器物层面问题。世界各国对于采纳何种物权变动模式更为妥帖更符合法理和国情也是众说纷纭。与英美法系不同,大陆法系各国由于采纳民法法典化模式使得这个问题更加敏感,所产生的学术争论也更加激烈。我国在制定民法典的进程中,选择何种物权变动模式以及如何使其与我国的相关法律制度协调一致是一个值得思考的问题。通过论证,本文认为物权变动的抽象原则作为德国物权行为理论中的最核心的内容,对规范当今大陆法系国家的物权变动具有很高的理论借鉴意义。特别是我国在制定民法典的进程中,更应该放眼世界,汲取世界民法史理论的精华,规避其缺陷,最大限度的减少立法成本。采纳物权变动的抽象原则,并以该原则指导民法典中有关物权变动的相关部分,是一种立法成本较低,法理更为科学而且更具实践的可操作性的立法模式。否认该原则而建立的物权变动模式在法理上是不完备的甚至是有缺陷的,在实践中也出现了一些问题。更多还原

【Abstract】 The establishment of the change models of property right is of great significance to the formulation and development of the civil law of a country. The change models of property right have been more and more incorporated into the scope of study of the civil law scholars both at home and abroad in that this is not only jurisprudence issue of very high theoretical value but also an issue in a material dimension of very high practical value. In the process of the formulation of property right and how to coordinate it with the pertinent legal systems of China is a matter deserving deliberation. This thesis holds the view that the abstract principle governing the change of property right, as the uttermost core of German theories of property right act, is of great theoretical learning significance to regulating the change of property right of current countries belonging; to the continental law system. In particular, in the process of the formulation of the civil code of our country, we should draw on the quintessence of the theories of world civil law history, and avoid their defects so as to reduce the legislative cost to the maximum. To adopt the abstract principle governing the change of property right is a legislative model of lower legislative more operable practically.更多还原
