【摘要】 目前全球金融市场正面临一场特殊的变革,新产品、新技术不断产生,跨国融资活动大量涌现,诸多力量共同改变了传统的金融格局。金融混业经营现象及其对传统金融监管模式的冲击,不仅引起理论界的密切关注,也使各国金融管理当局面临艰难的选择。如何看待金融混业经营现象,如何合理评估其造成的影响,并采取妥善的对策措施,这需要立足现代经济学的理论,对这种现象作多维度、全面的分析研究。本文旨在从现实出发,全面考察当前金融混业经营的发展趋势及其对金融监管的影响,并以此为背景,探讨中国目前的金融分业管制政策安排及未来金融监管体制的选择问题。 本文主要基于以下逻辑顺序展开论述:第一章为导论,对全文的分析思路、结构安排作了概况性描述;第二章,从分析金融经营监管理论与实践的历史演变入手,提出国际金融监管体制的发展趋势;第三章,从市场分工理论出发,结合当前美国流行的功能观点,提出金融体系结构性变化的新解释。同时还分析了一个金融业经营监管体制变迁的理论框架,即金融经营监管体制是在金融创新与金融监管的动态博弈,以及金融结构与金融监管的动态适应中形成和发展的,并在这些理论分析的基础上比较功能监管与机构监管;第四章,通过对美国、英国、日本、德国的金融监管体制改革的比较分析,尤其是对各国金融监管体制演变及其原因的实证研究,为前文的理论演绎提供实证依据,也试图从案例中找寻金融监管体制改革可以借鉴的因素;第五章,从我国具体实践出发,从实证角度考察了在目前环境下我国金融结构变化的新特点,银行业、证券业、保险业、信托业、非金融业务之间的交叉经营的问题,以及对现行分业监管模式的评估;最后,在第六章中提出了功能性监管体制在我国的必要性,并于中国未来金融经营监管体制结构的发展提出了相应对策,对其模式、过渡方式及配套性条件作了较全面、深入的分析。 本文的基本结论是:我国通过金融分业管制来维持金融业的稳定只能是一个临时性或阶段性的安排。从现实主义角度看,必须重视当前的金融创新浪潮与金融结构变化对全球金融监管体系结构、金融监管制度、金融法律体系所带来的深远影响。当前我国金融体系必须逐步适应这种全球性的金融混业潮流,但又应充分考虑中国的国情,金融监管体制的改革方向是一元化功能监管,但是采取“渐进过渡策略”最可取。更多还原

【Abstract】 The world financial markets are experiencing a special revolution. The emerging of new product, new technique and cross-border financing has changed the traditional financial structure. The phenomenon of financial mixed operation and it’s impact on traditional supervision model have not only attracted theory-researchers’ attention but also financial regulators into marking bitter option. How to view the phenomenon of mixed financial business, how to evaluate it’s influence and make reasonable response, which need make multi-dimensional and comprehensive analysis based on modern economic theories. The thesis is aimed at doing systematically examining the global trend of mixed business and it’s impact on financial supervision. Additionally, based on this trend, we also discuss China’s financial separated control model and it’s fate in the future.The thesis is based on the following logic to develop the viewpoints. The first chapter is introduction, this part is to summarize the analysis clue, structural arrangement and elemental innovation. In the second chapter, after analyzing current financial supervision theory and the evolutions of financial practice, we put forward with a new tendency for international financial regulation. In the third chapter, starting from market-division theory and combining it with functional perspective, we provided a new interpretation for financial mixed business. Furthermore, we introduced a theoretic framework about the transformation of financial business and regulation. The theory explained that there is a logical and consequent relationship among financial structure and financial innovation and the transformation of financial business and regulation. In the forth chapter, based on a comparison with the supervision systems in the US, the UK, Japan and Germany and on the study of the evolutions and causes in particular, we attempted to draw some valuable experiences. In the fifth chapter, we launch a home research, studying the efficiency of parallel supervision.
