【副题名】一种基于生产能力竞争的分析

【摘要】 20世纪90年代中期以来,国际上反倾销案件日益增多,立案数量呈现迅速增长的趋势,其中大多数案件发生在金属冶炼、化工等典型的不完全竞争产业。本文试图利用产业组织理论中的一些研究工具,通过对倾销和反倾销过程中进口国市场上各个企业之间的竞争行为的分析,讨论不完全竞争市场上反倾销措施可能产生的影响。 在不完全竞争的进口国市场上,由于受到生产能力约束、信息不完全等条件的限制,外国企业的倾销行为不是简单的价格竞争,而是一种生产能力竞争。在生产能力竞争中,外国企业的倾销行为将会引起非倾销企业的对抗。非倾销企业的对抗将导致进口国国内产业所遭受的损失进一步提高。反倾销措施虽然能够有效地制止外国企业的倾销行为,但是无法约束非倾销企业针对倾销做出的反应。因此,反倾销措施并不能够完全消除倾销行为所造成的消极影响,对进口国国内产业的保护程度也有可能是不足的。 同时,反倾销措施在现实运用中面临诸多问题导致反倾销措施无法事先有效地阻止倾销的发生。在不完全竞争的进口国市场上,反倾销措施对倾销企业的制裁有可能为其他企业采取掠夺性定价手段开辟道路,从而使进口国国内产业面临“第二次损害”。 基于以上分析,本文认为在不完全竞争市场上反倾销措施对进口国国内产业的保护有可能并不理想。当进口国政府希望通过反倾销措施保护其国内产业时,对此必须有充分的考虑。更多还原

【Abstract】 Since the last decade of 20th century, the use of AD became more popular, and the quantity of antidumping cases in international trade increased sharply. Most of these cases occurred in typical imperfect competition industry, such as base metals industry, chemical industry, and so on. With the tools of industrial organization, this paper analyzes the effect of AD in imperfect competition industry, through the study on the competition and gambling among the enterprises in the market of import country.In the imperfect competition market of import country, with the restriction of product capacity and asymmetric information, dumping is a product capacity competition, rather than a kind of price competition. Because dumping could arouse the counteraction of non-dumping enterprises: expanding their product capacity, the situation of import country’s industry would deteriorate. Although AD can restrain dumping, the counteraction of non-dumping enterprises aim at dumping behavior would never be offset by it. Therefore, AD cannot set off all negative effect of dumping, and can’t supply a sufficient protection for industry of import country.At the mean time, there are many problems in the use of AD, which result in inefficiency of AD. AD maybe only smooth away rivals for new dumping enterprises, and the industry of import country would encounter another dumping and another hurt.This paper try to draw such a conclusion that, in imperfect competition market, the protection of AD may be not efficient as it has been anticipated. When the government of import country tries to protect its domestic industry with AD, the above conclusion should be taken into consideration.更多还原
