【摘要】 行政监察是内部行政监督的一种主要类型,它是指依法设置在行政系统内部的专司监督职能的机关对国家行政机关、国家公务员和国家行政机关任命的其他人员执行国家法律、法规、政策和决定、命令的情况进行监督,并对违法、违纪行为予以查处的活动。现代政治生活的实践表明,健全的法制是对权力实行有效监督的重要基础,即权力必须在制度和法律的范围内运行。 随着我国民主法制建设的不断深入,行政监察制度在推进廉政建设和反腐败斗争、促进依法行政方针的落实、完善行政管理与监督体制等方面发挥着越来越重要的作用。然而,我国的现行行政监察制度毕竟还是一项年轻的制度,许多方面还不够健全,监察工作中的某些重大理论与实践问题还有待于进一步研究和解决。结合监察理论的研究,考察我国行政监察制度的历史发展,借鉴国内外不同类型行政监察制度的成功经验,对我国行政监察制度的现状进行深入的分析,深感我国行政监察制度仍存在着许多不足:法律地位不独立、权威性差,机构设置和领导体制不合理,监察职权范围过窄。因此,有必要对不同国家和不同历史时期行政临察的领导体制、机构设置、权力范围等进行研究,揭示监察工作的基本特点和规律,为进一步完善监察制度提供科学的理论依据以及具体对策。借用比较分析和历史分析的方法,在理论与实践相结合的基础上,笔者对重构我国行政监察制度提出了几点思考:赋予行政监察机关独立的宪法地位,建立健全行政监察法律体系,修改《行政监察法》相关规定,完善我国行政监察职能的运行机制以及加强行政监察队伍的自身建设。文章特别强调了行政监察的独立性,体现在:赋予行政监察独立宪法地位;改革现有机构设置和领导体制,将行政监察机关从同级人民政府和同级纪检部门中独立出来;给予行政监察独立人事保障和经济保证等。希望这些建议能为推进我国行政监察制度的改革与完善贡献一点微薄之力。更多还原

【Abstract】 The administration supervision is a main type of inside administrative controls, it is a special department which set up in the administrative system and supervises the national administrative organ, national civil servant and other national personnel in carrying out the law and regulations, policy and determine, with supervision function, and investigates and prosecutes the activities breaking the law, activities against discipline. Practice of the modern political indicates, good legal system is an important foundation supervised effectively to power, namely the operation of power must be in the ranges of the system and law.With the deepening constantly of democracy and legal system building of our country, the administrative supervision is playing a more and more important role during the construction of a clean government and anti-corruption struggle, perfection administration of policy and supervise system mechanism. However, the administrative supervisory of China is still a young system, a lot of respects are not enough, some theory and practice problems await studying and solving further. Combine the research of theory, investigate the historical development of the supervisory of our country, the successful experience of foreign countries, carry on deep analysis to the current situation of the supervisory of our country, feel deeply that the supervisory of our country still exists in the following aspects: Legal status the independence, authoritativeness poor, organization structuring and leadership structure are unreasonable, the limits of functions and powers. So necessary to carry on research to different country and different historical period leadership structure, organization structuring, power range, etc. offer the scientific theoretical foundation and concrete countermeasure for perfecting the supervisory further.
