【摘要】 本文分别从图书馆版权平衡的理论与实践两个角度论述、分析了版权平衡的产生、发展,版权平衡问题在数字图书馆环境下的突出表现形式,它是怎样发挥作用的以及数字网络环境下著作权法在处理图书馆版权平衡关系时存在的亟待解决的问题。全文共分6 章。第一章简要提出图书馆版权平衡的含义及其产生的社会原因。在此基础上分析图书馆与著作权法的内在联系。指出图书馆版权利益平衡是图书馆活动与著作权法二者内在联系的集中表现。第二章从法理和社会经济、技术发展的角度对图书馆版权平衡进行了详细分析。首先以法理中法的三种特征为依据,分别论述了:法律是调整各种利益关系的工具,利益平衡原则是规范版权平衡精神的理论基础;法律以行为关系为判断标准是图书馆版权平衡分析的微观切入点;权利和义务的相互作用是实现图书馆版权平衡的利导机制。其次,第二章又从经济技术角度论述了商品经济的兴起促成精神文化产业的形成,从而引起各文化产业之间版权利益的要求和平衡;科学技术的发展又从另一个角度推动了文化产业分成各种角色的利益主体,从而促成在作品生产者、传播者、出版者和使用者之间的版权平衡要求。从第三章起进入具体的图书馆版权利益平衡实践分析。第三章从图书馆信息资源建设角度,介绍了图书馆在数字化馆藏资源和对外采购电子资源数据库时遇到的版权问题。重点分析了图书馆以许可方式采购数字资源时应该怎样尽力减少公众利益所受到的侵犯,以争取与出版商之间达成利益的均衡。第四章论述了版权平衡在图书馆信息服务过程中的诸方面表现。这部分以许可合同、法定许可、合理使用三种版权例外形式为线索,分别分析了许可合同方式给图书馆版权平衡带来的影响;法定许可在版权平衡中起到的维护图书馆所代表的公众利益的作用以及网络环境对合理使用的削弱这三方面问题。第五章以法的局限性为理论出发点,择选延长著作权保护期的问题以及数字作品的许可使用和版权技术保护措施的强化两方面,分析在数字技术环境下著作权法未能跳出更多还原

【Abstract】 This dissertation systematically analyses the origination and developmentof copyright interest balance both theoretically and practically, and studiesits outstanding manifestations and its problems in the digital network.The paper comprises six chapters. The chapter One briefly proposes theconcept of Library Copyright Balance and the social reasons of this theory. Basedon these ideas, the author looked further into the inner relationship betweenlibrary and the Copyright Law, and got the conclusion that Library CopyrightBalance is the concentrated expression of these two.According to the three characters of law, the chapter Two discusses thatinterest balance principle is theoretical foundation of the essential expressionof the library copyright balance spirit. The judging criterion of behaviorrelationship is a micro way to analyze the copyright balance.By the reciprocitybetween right and duty leads to realize copyright balance. Besides that thefunctions of economy and technology on Copyright Interest Balance are alsoexpounded in chapter Two.From the chapter Three, this paper goes into practical analysis on librarycopyright balance. This part pays great attention to deal with the CopyrightInterest Balance when libraries digitalize their own information sources andpurchase electronic databases from publisher.The chapter Four studies several kinds of manifestations of CopyrightBalance in the process of library information service, and analyses the effectson maintaining library copyright balance by “license contract”and the LegalPermission’s function in protesting public interests and the decrease of ProperUse by network.In chapter Five, this paper firstly analyses the localized quality of law,then points out the displays of favoritism and delay in Copyright Law when thelaw was used to deal with Library Copyright Balance problems in digital andtechnological environment.The last chapter summarizes the long-term significance of Copyright InterestBalance in the knowledge economy, and indicates its importance in library sciencedomain and in the development of the whole social science and culture.更多还原
