【摘要】 中国职业足球已历经十余年,从其踏上职业化道路的那一刻起,就注定成为世人注目的焦点之一。这十余年来,中国职业足球发展历经了一个从无到有、从快到慢的过程。近年来,中国职业足球进一步深入发展,与国外足球直接交流的同时,赌球、黑哨、关联问题也陆续登陆中国职业足球赛场。此外,国内方面中国足协与职业俱乐部投资方的摩擦持续升温,加之中国各级国家队在各级别赛事上持续“低迷”状态,足球改革之声、法治建设之音遂起,并成为人们心目中中国足球的“救世主”。本论文主要通过文献资料法、问卷调查法、比较研究法、数理统计法、专家访谈法等方法,主要在以下几个方面对中国足球职业化进程中法治建设进行研究:(一)法治建设基本理论的研究。(二)中国职业足球法治建设的背景及成果。(三)足球法治建设对中国足球协会的挑战。(四)中国足球职业联赛法治建设的突破口。(五)国外职业足球法治建设的启示。本文研究的结果:(一)中国职业足球法治建设的迫切需要。近些年,职业足球逐渐走向一条“崎岖”之路。中国足协和俱乐部投资方矛盾公开化;球场赌球之风骤起:球场暴力盛行;裁判员风波此起彼伏等等都让人感到了职业足球法治建设的迫切性。(二)当前,中国职业足球法治建设整体水平比较落后。尽管在“红山口”会议之后的余年间,中国职业足球初期发展的速度曾让人欣喜不已。然而,这并不能使中国职业足球法治建设一劳永逸,步入新世纪的职业足球对法治建设的要求日新月异。当前中国职业足球法治建设已不能满足职业足球发展的需要。(三)中国职业联赛的进一步发展带给中国足协巨大的挑战。中超联赛的管理机制、权限混乱,联赛水平日趋低劣,比赛公信度降至极点:运营机制不成熟导致联赛环境极其恶劣,经营业绩每况愈下;财务不透明、不公开等等都已给中国足协带来了巨大的挑战。(四)中国足球职业联赛需要新的秩序。赌球、黑哨、关联……曾一度让中国的足球市场变得战战兢兢、如履薄冰,粉末登场的中国足球超级联赛也在一片冷清中结束。中国足球职业联赛需建立新秩序,严历打击赌球、黑哨、关联等现象,重新建立起有序的市场。最后,本论文对中国职业法治建设提出如下建议:(一)明确“法治”与“法制”涵义的区别。(二)有效处理好权力问题。(三)构建有限政府。(四)构建开放政府,竞选上任,财务公开,主动接受公众监督。(五)构建责任政府。(六)法治主导型国家,建立法治主导型职业联赛。(七)司法介入,加强社会监督。(八)在足球领域建立并执行“违宪审查”制度。更多还原

【Abstract】 Chinese professional football league matches have been developing for over ten years. It just focus on people’s eyes as soon as it begins its first-year-league-match. In these years, it is the process of none-to-existing and fast-to-slow which Chinese professional football has undergoes.When it continues to develop through communicating with other countries, the phenomenons of gambling, black whistle and "relationship" appear in our league matches.In addition, As the conflict between Chinese football association and club investors is rising and the national football team do not get any success in the world, rule of law building becomes a key to change the situation.The thesis makes the research through ways of literature, questionnaire, comparation, statistics and experts inquiry.lt focus on fields as below: 1.Basic research on rule of law building. 2.The achievement the Chinese football association has got during last ten years. 3.The challenge to Chinese football association made by rule of law building in Chinese professional football. 4.The short cut of rule of law building in Chinese professional football.5.The apocalypses in foreign professional football league matches.The outcomes the thesis reach: 1. Chinese professional football is in dire need of rule of law building. 2. Chinese professional football faces a bad rule of law building situation in recent years. 3.Further development of Chinese professional football league matches brings a giant challenge to Chinese football association.4.Chinese professional football league matches need a new league matches orders.In the end the thesis offer several suggestions as follow: 1 .Make good understanding of two words "rule of law" and "legal system". 2. Advocating the balance of power in Chinese football association.3. Found the "finite government". 4. Found the "open-up government".5. Found the" duty government ".6.Make the Chinese professional football league matches as a "rule of law"-type league matches.7.Let judicature in and strengthen public superintending.8.
