中国网络新闻法制建设研究

【摘要】 1995年,《神州学人》和《中国贸易报》电子版的出现,中国网络新闻正式走上了时代的舞台。网络新闻作为一种重要的新闻传播形态,在我国经过十年的蓬勃快速发展已经初具规模,对社会发展和人们生活发挥着不可估量的作用。然而,任何事物都有两面性,网络新闻在发展的同时也掩藏着危机。由网络新闻引发的新闻侵权、恶性传播、网络犯罪等新问题层出不穷,利用法律手段规范网络新闻传播已经到了刻不容缓的地步,网络新闻法制研究也相应地日益引起社会各界的关注。从1994年我国第一个互联网法律出台至今,已经有12个年头。在这十几年中,我国政府高度重视互联网络的发展,不断有新的法律法规出台,使得我国网络法制建设日趋完善,这为我们进行网络新闻法制建设研究提供了依据。本文以中国网络新闻法制建设为研究对象,在简要分析我国网络新闻事业发展的基础上,具体阐述目前它所存在的问题,从而揭示现在我们强调网络新闻法制化建设的重要性和现实意义。论文重点是通过分析我国网络新闻法制建设的现状,归纳总结它的特点和缺欠,从而进一步探讨和研究网络新闻法制建设的发展与完善,并给予建设性的意见。期望本篇论文能对我国网络新闻的法制化建设起到一定的启示和借鉴作用。论文主要分五章展开论述:第一章:中国网络新闻发展概述。本章对我国网络新闻的发展进行了简要的梳理,对它在发展趋势、新闻价值观、时间观、编辑观、传播方式、传播理念六大方面所呈现出来的新特点进行了剖析,目的在于揭示并阐述目前我国网络新闻发展所存在的问题。第二章:当前强调网络新闻法制建设的现实意义。目前对于网络新闻的管理可谓是仁者见仁,智者见智。本章将目前社会各界对此存在的观点进行汇总,将其归纳为四类:政府管制论、道德约束论、技术惟一论、法制建设论。本章具体剖析了四大观点的主张和特点,揭示了当前强调构建网络新闻法制框架的重要性和现实意义。第三章:我国网络新闻法制建设现状概述。本章首先从网络新闻监管机构和法律体系建设两方面阐述了我国网络新闻法制化进程,并着重对网络新闻法制化进程中呈现出的特点和缺欠进行了剖析。 第四章:完善我国网络新闻法制建设的思考。这是本篇论文较为重点的章节,主要通过实例解析,从立法理念、立法思路、立法原则、立法内容四大方面对我国网络新闻法制化建设的现状进行了深刻的反思,并提出了相应的主张。 第五章:网络新闻法制建设展望与建议。我国网络新闻法制建设不是一跋而就的,而是一个系统工程,它牵涉到的问题方方面面。本章对我国网络新闻法制建设给出了几点参考建议,主要包括:加强对法律的修改与制定、加强国际合作和技术协助、注重对网络新闻侵权的立法和网络道德建设。期望这些建议能对网络新闻法制化建设起到一定的借鉴作用。关键词:网络新闻,法制建设,新闻侵权更多还原

【Abstract】 With the emergence of network version of 《China Learner》 and 《China Trade Paper 》 in 1995, Chinese network news spread formally comes on the stage of the ages. As an important way of news spread, network news has already had a early scale after ten years’ rapidly developing and has been performing an inestimable function for social development and people’s living. However, everything has both sides. With the developing of network news, it also hides the crisis. The new problems caused by network news, such as news infringement, malignant spread and network crime, emerge in endlessly. It has no time to delay to make use of the law to regulate network news spread. Accordingly, the research of network news legal system also increasingly catches people’ eyes in social circles.It is 12 years since 1994 that the first law of our country for Internet came on. In these more than ten years, our government have been paying much attention to the internet development and continuously making new laws out, which makes the network legal system building of our country gradually perfect and provides base for network news legal system building research. This text regards network news legal system building as the research objection. On the base of analyzing the our country network journalism development in brief, the text expatiates its’ existing problem in order to announce to the importance and the realistic meaning of which now we emphasize network news legal system building. The key point of Thesis is to summarize its characteristics and shortages by analyzing the our country network news legal building actuality, thereby discuss and research, and give the constructive development opinion .Toexpect that this article can offer enlightenment and reference certainly to our country network news legal system building.The thesis divides primarily five chapters to discuss: Chapter 1: The summary of Chinese network news development. This chapter had a brief treatise to our country network news development, anatomized new characteristics from six aspects, for example the developing trend, news value view, time view, edit view, spreading way and spreading principle, in order to expatiate the current our country Netnews problems when developing.Chapter 2: to emphasize the realistic meaning of network news legal system building. There are many different points about management toward Netnews. This chapter gathered existent standpoints in social circles, and induced to four types: the government control theory, morals controls theory, technique unique theory, and legal system building theory. By specifically analyzing characteristics for four standpoints, this chapter expatiated the importance and the realistic meaning of setting up network news legal system frame.Chapter 3: The summary of our country Netnews legal system building present condition. This chapter expatiated our country network news legalization progress from both sides between administering organization and legal system building, and emphasized to anatomy its characteristics and shortages.Chapter 4:The thinking of perfecting our country network news legal system building. This is the more important chapter. It gave the deep-level thinking to our country network news legal system actuality from four aspects about the lawmaking ideas, lawmaking ways of thinking, lawmaking principles and lawmaking contents, and gave to constructive consult opinions.Chapter 5: Outlook and suggestion of network news legal systembuilding. Network news legal system building is a systems engineering, which concerns many things. This chapter tried to give suggestions to our country network news legal system building, including primarily: to enhance the establishment and modification of the law, to enhance the international cooperating and technology help, to pay attention to the lawmaking of the news infringement and network morals building.
