【摘要】 哈耶克是二十世纪具有世界影响的思想家,其思想涉及到经济学、社会哲学、政治哲学、法学等诸多领域,建树甚丰。他一生最为显赫的功绩在于对计划经济体制提出了系统的批判,并详细论证了市场经济秩序建立与运转的内在机制,他的思想对于处在转型期的中国来讲具有极其重要的借鉴意义。本文试图以对“规则”的考察为主线,对哈耶克诸项基本理念进行一次初步的探析,并在比较哈耶克与马克思相关论点的基础上,提出自己初步的评价。第一章在初步分析“规则”概念基础上界定了“规则理论”的主要内容,并简要地回顾了“规则理论”的历史发展过程。第二章描述了哈耶克学术活动的重心所在,分析了与规则理论密切相关的几个基本概念,即“自由”、“知识”与“规则”,指出哈耶克的规则理论是以“自由”为导向,以知识类型学为基础,以规则为论证手段的理论体系。第三章将哈耶克规则理论与马克思的生产关系理论进行比较,认为哈耶克规则理论弥补了马克思生产关系理论的不足,但也存在着脱离具体的历史过程进行抽象论证的缺陷。最后,本文试图以哈耶克民主、法治理念为参照,分析哈耶克规则理论对中国法治建设的积极意义。更多还原

【Abstract】 Hayek is a thinker who has the world influence in 20 century, his thought involves many realm, for example, the economics, social philosophy, law etc. The achievements is very plentiful. The most imposing merit in his whole life consist in putting forward the judgment of the system to the planned economy system, combining detailed argument the market economy order establish with the inside mechanism that revolves, his thought has specially important meanings for China in transforming period. This text try to regard investigating to the “rule” as the main line, discusses and analyzes Hayek’s basic principle, and on the foundation of comparing the Hayek with Marx, puts forward my first-step evaluation.In order to demarcating the “rule theory”, the first part of the article pays attention to the definition of the concept of “rule”, and looks back it’s history.The second part simply describes Hayek’s academia, points out the center of his scholarship activity, analyzes several basic concept closely-related with “rule theory”: ”freedom”, ”knowledge” and ”rule”, then draws the conclusion that his theory system takes the “freedom” as major idea, the “knowledge taxology” as foundation, the “rule” as demonstrating measure.The third part dedicates the comparison of Hayek’s “rule theory” and Marx’s “producing-relation theory”, the ultimateness is the former offsets the lack of the latter, but also exists the blemish that only attach importance to abstract argument , deviating from the concrete history process .the eventual part try to combine H ayek ‘s standpoint of democracy , rule of law principle with the fact of China and find the positive meaning for Chinese rule of law development .更多还原
