【摘要】 互联网在全球范围特别是在中国的迅速扩展,对传统社会产生了很大冲击和挑战,而伴随网络而发展的网络色情对整个社会的负面影响更是难以估计,因为网络色情的蔓延及其严重性并不仅仅在于网络色情信息的多少,更在于它由此对现实社会人们心理和健康的严重危害。目前,网络色情已成为社会各界普遍关注的问题,全世界有关网络色情传播的研究已经在各国展开,但还没有取得明显的进展。如何遏止网络色情的传播,这是一个世界性的话题和难题。本文采用资料分析法和法律理论为主要理论支撑,从网络色情的传播现状、特点,网络色情的立法控制、道德规范、技术遏制以及国际合作等方面探讨了现阶段网络色情控制存在的问题及障碍。在此基础上,借鉴国际上各国控制网络色情的成功经验和国内一些研究成果,有针对性地提出了若干建议和对策。论文首先从分析网络色情的特性和特点入手,探讨了网络色情的标准性问题。然后重点论述了中国如何从立法上控制网络色情的应对策略。文章提出:控制网络色情需要建立完善的网络色情监管的专门机构、对提供网络色情服务人员的责任进行区分对待、强化对未成年人的立法保护以及加强对网络色情违法犯罪行为的处罚等具体措施。针对中国网络技术发展发展和道德建设的现状,以及国际合作打击网络色情的成功案例,论文在最后还提出了一些可行性的应对措施。更多还原

【Abstract】 The Internet spreads rapidly over the world and China, especially challenging tradition society. But the development of network eroticism has a result of the influence of positive to our society, because the network eroticism is spreading quickly and its seriousness lies in impairing people’s minds and healthy. At present, the network eroticism has been a problem that has been paid attention to by the public. The research that involves network eroticism has launched in all countries throughout the world, but there is no so big progress. How to stop the communication of network eroticism, is a world topic and knotty problem.With the methods of data analysis and theories of law as its main theories, this thesis inquires into problems and obstacles that the control of network eroticism existed now from its current situation, characteristics, law controls, moral norms, technique suppresses and international cooperation etc. Basing on it, this thesis draws lessons from the successful experience that controls network eroticism of other countries and research results of our country, and puts forward some directly suggestions and counter plans.First, this thesis analyzes the characteristics of the network eroticism, and inquiries into the standard problem of the network eroticism. Then, this thesis discusses the strategy that China how to control the network eroticism from the lawmaking emphatically. The article puts forward: to control the network eroticism demand establish the specialized organization that takes charge of the network eroticism, distinct the duty of personals that provide the network eroticism attendant, enhance lawmaking protection to teenager and enhance the punishment to illegality and offence of network eroticism. Finally, according to the developments of Chinese network technique and current situation of moral development, and the successful cases that the international cooperation attacks the network eroticism, the thesis also puts forward some feasible measures.更多还原
