【摘要】 证据交换制度在国外已经发展得比较完善和成熟，在我国才刚刚初步建立。证据交换制度在我国的出现，是我国民事审判方式改革过程中的一种大胆尝试，不管其实施效果如何，证据交换制度都对我国的整个民事诉讼体系带来了巨大的挑战。本文主要从制度结构和法理两方面对国外证据交换制度进行了介绍和分析，对其对我国的司法现状所带来了的挑战进行了剖析，并对证据交换制度今后在我国的完善提出了具体构思和设计。更多还原

【Abstract】 Evidence disclosure procedure has developed into a sophisticated degree in western countries, but is still at the initial stage in China. The introduction of evidence disclosure procedure to our country is a bold attempt in the reform of civil judicial procedure. Whatever effect it is, the evidence disclosure procedure has brought great challenges to the whole civil procedure law of China. The thesis introduced and analyzed the foreign evidence disclosure procedure in terms of procedure structure and jurisprudence. Then the author dissected the challenges the evidence disclosure procedure brought to our country, and finally offered some suggestions to the perfecting of the procedure in China.更多还原
