【摘要】 随着环境污染事件的增多，法律法规的僵硬划一无法有效的解决环境污染纠纷、遏制环境污染事件的发生。地方政府和企业对于地区地理环境和民情风俗有更加深刻的了解，如果地方政府与企业签订环境保护协定，切实制定防治环境污染、保护环境的对策，不仅能够预防环境污染的发生、消除环境污染纠纷于无形之中，而且能够促进企业与地方居民的和谐共荣，达到环境保护与经济共同繁荣的可持续发展的目的。 环境保护协定具有事先防止环境污染事件发生以及事后有效解决环境污染纠纷的功能，本文旨在以日本的公害防止协定和台湾的环境保护协定为基础，分析环境保护协定的定义、内容和法律性质，探讨其理论基础，进而结合我国的实际，论证了在我国构建环境保护协定制度的必要性和可行性，提出了相关建议。 本文共分为五章，第一章介绍环境保护协定制度的发展概况。主要介绍了日本和台湾和西方国家的情况，通过这种纵向的考察，笔者想说明环境保护协定制度已经是世界范围内环境法制的新发展。 第二章阐述了环境保护协定的定义、基本内容和法律性质，从总体上对环境保护协定进行了说明。 第三章对环境保护协定的理论根据进行了探讨，主要是从政府行政管理模式和非强制行政的角度进行的分析。 第四章则结合我国的实际，论证了在我国构建环境保护协定制度的必要性和可行性，回答了为什么在我国引入该制度，以及该制度在我国的发展基础。 第五章综合以上各章的讨论和说明，提出在我国实施环境保护协定所应当遵循的原则和协定的基本内容，以及救济问题。更多还原

【Abstract】 With the increase of environment pollution, the laws and codes which are so uniformity can not effectively solve and prevent pollution events. The local governments and enterprises are familiar with the geography environment and the situation of the people, so if they endorse a contract which set down countermeasures to prevent pollution and protect environment, the pollution and disputes will be prevent and the harmony between local resident and enterprise will be strengthened, finally the aim of sustainable development will be reached.The contract of protection-environment can prevent the environment pollution in advance and solve the disputes effectively afterwards. Refer to the environment and pollution control agreements in Japan and the contract of protection-environment in Taiwan, this thesis analyses the definition content and legal character of the contract of protection-environment, discusses the theory basis for it. And then demonstrates the necessary and feasibility to set up this system in our country, and how to set up.The whole thesis is divided into 5parts:Chapter 1 introduces the general development situation of the contract of protection-environment, especially in Japan and Taiwan. From this we can see that the contract of protection-environment is a new trend in the world.Chapter 2 sets forth the definition content and legal character of the contract of protection-environment, so we can have a whole understanding about it.Chapter 3 discusses the theory basic for it, mainly on the government mode and non-forced administration.Chapter 4 demonstrates the necessary and feasibility to set up this system in our country, answers why to set up this system in our country and the practice basic for it.Chapter 5 brings forward how to set up the contract of protection-environment, just as the aim principles and contents and how to ensure its enforcement.更多还原
