【摘要】 为了全面地阐述“保险法诚实信用原则”，本文以哲学、法理学价值方法、规范的方法、实证的方法来探讨保险法诚实信用原则。在广泛深入归纳分析国内外相关问题的资料基础上，对保险法诚信义务进行了比较。 全文共分四个部分：在保险法诚实信用原则内涵研究中，本文从道德和法律两个方面进行阐述，进而提出诚实信用原则是在保险实践中不断发生变化的，其实质为追求公平正义之结果，作者继而又从三个方面论证了保险合同是最大诚信合同，首次就保险法诚实信用原则适用中几个法律问题作了些探讨；在第二部分中，本文通过对现有资料整理分析，比较了保险法诚信义务在国外和我国台湾、香港、澳门地区保险法律法规中的具体适用；在第三部分中，本文对我国保险立法现状进行了探讨，并对我国《保险法》未作规定和不完善之处，在借鉴国外立法经验的基础上，提出了修改和完善的具体建议，并力争构建和完善我国保险立法理论体系；最后，本文运用了典型案例分析论证了诚实信用原则在我国保险实务中存在问题，产生的原因并提出了若干建议。更多还原

【Abstract】 In order to analyzing "good faith principle in insurance law" in full, this thesis makes a study on good faith in insurance law in ways of philosophy and jurisprudence and practical example approach. Based on summarizing relevant material, this makes a comparative study on good-faith responsibilities in insurance law.The thesis consists of four parts.As to the meanings of good faith in insurance law, the thesis discusses the issues on moral and legal levels, and then proposes that the principle has been changing in the insurance practice and it pursues for purpose of fairness and justice substantially. Furthermore, the thesis discusses and proves that insurance contract is utmost good faith contract. At first time, author makes a research on some legal issues in course of application of good faith principle; in the second part, through analyzing the current material, it compares the concrete application of good-faith responsibility in other country and Taiwan, Hong Kong, Macao. In the third parts, this thesis discusses the current situation on China relevant legislation, and puts forward some proposals for the blank and the unperfected parts, based on foreign experience, trying to construct and perfect theory system of insurance legislation of our country; at last, the thesis discusses and analyzes the existing problems and its reason on good faith principle hi insurance practice of our country, and puts forward some proposals.更多还原
