【摘要】 本文采用历史的、比较的和价值的分析方法，从分析英国普通法的形成和历史特征入手，集中探讨了美国宪法的英国普通法渊源。全文共分三章，约5万字。第一章对英国普通法的形成、特征和美国对英国普通法的继受进行了考古研究。文章指出，英国普通法是诺曼王朝王权强化和中央集权化的副产品，形成于王室法庭的司法过程，体现为判例法，其内容来源于地方性习惯。独立革命后的美国继受了英国普通法。第二章讨论了英国普通法传统在美国宪法中的体现。文章指出，美国宪法直接继承了英国普通法的法律至上学说、正当法律程序原则以及高级法观念。第三章分析了美国宪法的英国普通法渊源对我国宪政建设的启示，认为我们在宪政建设的过程中要尊重传统，认识到理性的有限性，选择适当的宪法变迁方式，保护既存的隐形宪政建设资源。更多还原

【Abstract】 With the historical, comparative and valuable methods and beginning at the analysis of the formation and the character of English common law ,the author has probed focusably the topic about the American constitution’s origination of the English common law.The paper consists of three chapters in which the characters add up to about 50000.The first chapter researchs archeologically the formation and characters of the English common law. As a law of case and with local custom as its content, the English common law is a by-product of the strengthening of King’s power and centralization and forms in King’s courts. America has recepted the English common law .The second chapter tells us that the American constitution has recepted the theory of "Lex,Rex"and due process of law and a theory of a higher law. The last chapter explores the meaning of the topic "the American constitution’s origination of the English common law "and insists that we should respect the historical traditions and realize the definition of ration and choose suitable way of constitution changing when we construct constitutional government in China.更多还原
