【摘要】 油污损害赔偿责任限制制度是海商法中独特而重要的法律制度，对保护海上运输业的发展有着重要的作用。因此为保障船舶所有人能够充分行使此项权利，应该制定适当的申请油污损害赔偿责任限制的程序法。 《中华人民共和国海事诉讼特别程序法》并没有明确规定其第九章和第十章所规定的海事赔偿责任限制基金的设立和债权登记、受偿程序是否适用于申请油污损害赔偿责任限制。本文通过比较申请油污损害赔偿责任限制与申请海事赔偿责任限制的不同点，指出目前《中华人民共和同海事诉讼特别程序法》并不能完全适用于申请油污损害赔偿责任限制。在此基础上，本文通过借鉴世界其他各国对此问题的规定，提出了在我国建立油污损害赔偿责任限制之诉的观点，并进一步探讨性的设计了完整的申请油污损害赔偿责任限制的程序。更多还原

【Abstract】 Limitation of liability for oil pollution is an antique and unique legal system in maritime law. which is essential to protect and promote the stable development of shipping industry. It is, therefore, very important to provide the proper procedure to ensure that the shipowner can fully evoke the limitation of liability for oil pollution.Special Maritime Procedure Law of People’s Republic of China has not clearly stipulated whether the chapter 9 (procedure for constitution of limitation fund for maritime claims) and chapter 10 (procedure for registration and repayment of the debts) apply to the application of limitation of liability for oil pollution. In this paper, through comparing the difference between the application of limitation of liability for maritime claims and the application of limitation of liability for oil pollution, the writer further points out that Special Maritime Procedure Law of People’s Republic of China could not fully apply to the application of limitation of liability for oil pollution. Based on this, the writer introduces the related provision of the other countries and then put forward to build up the limitation action for oil pollution. Finally, the writer designs the whole procedure for the application of limitation of liability for oil pollution.更多还原
