【摘要】 早期驻外使领是近代中国较早走向世界的一批官僚士大夫，也是晚清法律改革的启蒙者。在晚清法律变革的酝酿和准备阶段，他们在反对领事裁判权的基础上提出“中西合律”的改革思路，并大力介绍、引进西方法律文化，果敢提出多种改革建议，为晚清法律变革奔波不息。本文试图探讨早期驻外使领的法律思想及实践，并对其做出初步评判。 文章首先简单介绍早期驻外使领这一群体的形成过程，并指明他们是晚清法律改革的启蒙者。继而详细论述早期驻外使领的法律思想及实践，这是本文的重点。早期驻外使领的法律思想主要包含两方面内容：一是主张废除领事裁判权；再是提出“中西合律”的改革思路，即通过引进西方法律来实现对传统法律的改造。这些富有启蒙意义的思想，使他们成为晚清法律改革的启蒙者。他们在出使期间，热衷介绍、引进西方监狱制度、警察制度、律师制和陪审制度，积极倡导以法治国的法律观念，同时还针对形势的变化，建议清政府删除旧法，增订新法，这对清末法制改革有着很大的启发意义。最后着重分析早期驻外使领的法律思想及实践的积极意义，同时指出其不足，并再次明确早期驻外使领在晚清法律变革中的贡献和作用。更多还原

【Abstract】 The early ministers to foreign countries of late Qing Dynasty are a batch of scholar-bureaucrats who walked up to world earlier in modern China and also are the torchbearers of the legal reform of late Qing Dynasty. During the gestation of it, in order to abolish the consular jurisdiction, they proposed the thoughtfulness of legal innovation. At the same time, they introduced the western laws into China and put forward a series of suggestions. The present dissertation attempts a study on the legal thoughts and practice of the early missions to foreign countries of late Qing Dynasty, and gives them a preparatory evaluation.At the first place, the thesis introduces the formation of the early ministers to foreign countries, meanwhile, points out that they were the torchbearers of legal reform in the late Qing Dynasty. Secondly, it discusses the legal thoughts and practice of early ministers to foreign countries in the late Qing Dynasty, which is the pivots of the whole study. Their legal thoughts include two parts: one is to insist that the consular jurisdiction should be abolished, the other is to bring forward the thoughtfulness of reforming traditional laws which was to integrate the western laws into the traditional laws. These ideas with didacticism make them to be the torchbearers of legal reform in the late Qing Dynasty. When they were sent to foreign countries on diplomatic mission, they saw about the western laws such as police system, prison system, lawyer system and jury system and introduced them into China. In addition, they put forward a lot of suggestions according to the changes of the situation bravely. Their practice gave great illumination to Legal Reform of late Qing Dynasty. Lastly, the author analyses the advantage and disadvantage of the legal thoughts and practice of early ministers to foreign countries, and affirmes their contributions to the legal reform of late Qing Dynasty.更多还原
