金朝立法研究

【摘要】 金朝法律直接渊源于女真族的民族习惯，并始终保持了一部分行之有效的民族习惯法。因此，要谈金朝法律，必须先介绍一下女真习惯法。习惯法虽然产生于建国前，但在建国初期一直发挥着重大作用，具有相当的影响力。本文论述了习惯法的形成，以及在金初的沿用情况，从而分析出金朝初期的立法特点。 熙宗统治时期，金朝在中原的统治趋于稳定，女真社会开始由奴隶制向封建制转化。统治者已经开始接受中原正统思想，创制自己的法律体系。历经海陵、世宗，到章宗统治时期，金朝已经基本完成了由奴隶制向封建制的过渡，社会经济发展进入了兴盛阶段，其法制也得到了充分发展并趋于完善。在此期间，金朝不但制定了诸如《皇统制》、《正隆续降制书》、《军前权益条理》、《续行条理》、《大定重修制条》、《明昌律义》、《明昌敕条》、《泰和律义》和《新定律令敕条格式》等诸多的成文法典，而且，还制定了诸多的单行法规，颁布了大量的令、格、制、诏、敕等多种形式的法律。本文通过对金朝各种法律形式及其内容的比较研究，得出金朝制定有多种形式的法律，每种法律形式都有其独特的作用，它们一起共同构成金朝法律的整个体系，其内容也涉及到了刑事、民事、行政、经济等法律规范。从而全面揭示出金朝法律的作用以及在中国古代法制史上具有的重要地位。更多还原

【Abstract】 In this paper I will analyze how the law of the Jin Dynasty was legislated in chronological order as well as its characteristic by contrast. The law of the Jin Dynasty originated from the common law of Nuzhen nationality, which had been exerting an immense force in the early days of the Jin Dynasty. The Jin Dynasty began to create its legal system with Confucianism in the period of Xizong and the legal system tended to be perfect in the period of zhangzong. During this period, not only several board codes were formulated, but also some special regulations and a large number of laws in other forms were issued, with the accomplishing the transition of slavery to feudality, and its economy coming into the phase of prosperity. By comparison of thelegislations of the different periods of the Jin Dynasty, which--this paper will conclude--included several forms constituting the legal system and each of them performed a specificfunction respectively, and the content involved criminal, civil, administrative and economic laws. In deed, the function and the importance of it in Chinese legal system were displayed wholly.更多还原
