【摘要】 信用卡诈骗罪是发生在金融领域内的一种新型的金融诈骗犯罪，是利用信用卡作为犯罪工具和犯罪手段的一种智能性犯罪。近年来，随着社会主义市场经济的蓬勃发展，信用卡诈骗犯罪呈逐年上升趋势，涉案数额越来越大，对金融管理秩序所造成的危害也越来越严重，须引起立法、司法和理论研究部门的高度重视。 本文对信用卡诈骗罪的论述主要围绕三个方面进行：一是信用卡及信用卡诈骗罪概述；二是信用卡诈骗罪的犯罪构成；三是信用卡诈骗罪司法适用的若干问题。文章将刑法学理论的基本原理应用于信用卡诈骗罪，分析探讨了信用卡诈骗罪不同于普通诈骗罪的特殊犯罪构成，并针对信用卡诈骗罪在司法适用中常见的疑难和争议问题，如法定行为方式、罪与非罪、此罪与彼罪、既遂与未遂、罪数形态和共同犯罪等理论联系实际地进行了较为详尽的分析、论证，提出了自己的见解，具有较强的司法操作性。更多还原

【Abstract】 The crime of fraud of the credit card is a kind of new-type financial crime happening in the financial field, a kind of intelligent crime utilizing credit card as the guilty tool and crime means. In recent years, with the flourishing development of socialist market economy, the crime of fraud of the credit card shows a tendency to rise year by year, the number involved in the case is greater and greater, the danger is more and more serious to the financial manage order, which should attract the great attention of legislating, the administration of justice and theory research department.Argumentation of this text to crime of fraud of the credit card focuses mainly on three respects: First, The summary of the credit card and crime of fraud of the credit card; Second, the constitutive elements of crime of the crime of fraud of the credit card; Third, several judicial questions of administration of the crime of fraud of the credit card. The article applies the basic principle of the theory of criminal jurisprudence to the crime of fraud of the credit card, analyses and probes into special constitutive elements of the crime of fraud of the credit card that is different from the ordinary crime of fraud, after elaborately analyzing and demonstrating some common problems and disputes of the judicial applicability in the fraud of credit card, such as legal behavior way, crime and non-crime, this crime and another crimes, the accomplished and abortive, quantity of crime and complicity, offers its own view, which can be better operated in judicial activities.更多还原
