预防未成年人犯罪的法律教育研究

【摘要】 众所周知，法律教育是塑造人的品质，预防犯罪的重要手段，它对于预防未成年人犯罪的发生尤为重要。本文研究的重点就是如何通过法律教育以实现预防未成年人犯罪的问题。 文章从1999年6月28日第九届全国人民代表大会常务委员会第十次会议通过的《中华人民共和国预防未成年人犯罪法》(以下简称《预防未成年人犯罪法》)出发，以我国未成年人法律教育的实践为基点，在掌握大量相关的古今中外文献资料的基础上，从犯罪学、社会学、教育学等多学科的角度，对我国预防未成年人犯罪的法律教育问题进行了全面的分析和客观的评价，努力做到揭示本质，归纳要点，分析特色，吸取精华。 本文共分为四个部分，即绪论部分和分为三章论述的下文部分。 绪论部分主要介绍了对预防未成年人犯罪的法律教育问题进行研究的起因、以及这项研究具有的理论意义与现实意义。 第一章通过大量的实证资料对目前我国未成年人犯罪的趋势和类型以及预防未成年人犯罪的法律教育的现状进行了考察。通过对未成年人犯罪现状的考察，旨在证明法律教育对于预防未成年人犯罪的重要性。而对于预防未成年人犯罪法律教育现状的考察，旨在回答目前我国预防未成年人犯罪法律教育“是什么”和“怎么样”的问题。 第二章对我国预防未成年人犯罪的法律教育存在缺陷的原因进行了全面的探析。文章主要是从理论和制度两个层面宋探讨目前我国预防未成年人犯罪法律教育薄弱的原因。本章的论述旨在回答目前我国预防未成年人犯罪的法律教育的缺陷“为什么”存在的问题。 第三章探讨了我国预防未成年人犯罪法律教育的实现途径：通过对我国古代法律资料和英、美等国法律教育理论与实践资料的整理，探索了许多值得我们借鉴的经验和做法，本章的论述从六个角度展开。本章的论述旨在回答针对目前我国预防未成年人犯罪法律教育存在的缺陷“怎么办”的问题。 本文通过以上几个部分的分析和论述得出的结论是：法律教育是预防未成年人犯罪的重要途径之一，它对于预防未成年人犯罪的潜移默化的作用是其他预防手段所不可替代的。深入研究这一问题，对于丰富和发展法律教育的理论以及完善犯罪学理论，对于控制和预防未成年人犯罪都具有相当重要的理论和实践价值。当然，这项研究的深入，在理论上需要犯罪学、教育学、社会学等多个学科的参与，在实践上，则需要政府、学校、家长、社区的共同努力。具备了以上理论和实践两个方面的条件，法律教育一定能够实现未成年人犯罪的预防。更多还原

【Abstract】 Legal education is a well-known important measure to mould the quality of people and to realize the purpose of prevention of crime.For the prevention of juvenile delinquency, it is especially important .The emphasis of this paper concentrates on how to implement the prevention of juvenile delinquency through legal education.Based on the practice of legal education intended for minor offender in China and Law of the People’s Republic of China On the Prevention of Juvenile Delinquency adopted at the Tenth Session of the Standing Committee of the National People’s Congress on June,28,1999, the author tries to analyse and comment comprehensively on the function of legal education in preventing juvenile delinquency from the various perspective of criminoly,sociology and pedagogy.The horizontal and vertical researches value the paper in search of the essence of the role of legal education and contribution to the fullfillment of such function.This paper consists of introduction and text which is divided into three chaptert to discuss.In introduction the author mainly introduces the cause of the research for the legal education in preventing juvenile delinquency.The author also introduces the significance of the research theoretically and realistically.In Chapter l,the author have investigated the trend and style of juvenile delinquency at present in China using rich and demenstrative data.The author have also investigated the actuality of the legal education in preventing juvenile delinquency.The purpose of investigating the actuality of juvenile delinquency is to prove the importance of legal education in preventing juvenile delinquency.Where after investigating the actuality of the legal education in preventing juvenile delinquency ,the author tries to answer he question of What and How in the legal education in preventing juvenile delinquency at present in China.In Chapter 2, the author fully analyses the reason why there is limitation existed in legal education in preventing juvenile delinquency in China.The author discusses the reason why there is weakness existed in the legal education in preventing juvenile delinquency theoretically and institutionally.The statement of this chapter focuses on answering the question of Why for the limitation existed in the legal education in preventing juvenile delinquency in China.In Chapter 3,the author approaches the implementation measure to realize the legal education in preventing juvenile delinquency.The author have researched lots of experiences worthwhile to use for reference when the author sorts out the legal documents from old times in China and the theoretical and practical data of foreign contry such as Britain and America.The statement of this chapter,which is divided into six sessions,concentrates on answering the question of How for the limitation existed in the legal education in preventing juvenile delinquency in China.From the analyses and statement above,the author draws the conclusion:Iegal education is an important measure of the prevention of juvenile delinquency,its effect in prevention juvenile is unconsciously influenced,as far as this is concerned,legal education can not be replaced by other prevention measures.The deepgoing research for the subject, which is very significant theoretically and practically, is beneficial not only for the abundance and the development of the thoery of legal education and perfectness of the theory of criminology,but also for the controlling and the prevention of juvenile delinquency.Naturally,the deepgoing of the research relies on the participation of multiple subjects such as criminology,pedagogy and sociology theoretically and the joint efforts made by govement,schools,parents and community practically .The legal education will realize the prevention of juvenile delinquency if it is satisfied for the conditon of theory and pratice above .更多还原
