行政许可的存在价值及程序论略

【摘要】 行政许可作为一种行政行为方式，是行政主体对行政相对人的活动进行法律控制的重要手段。同时，它作为一种法律制度，对市场经济的发展完善也具有重要影响。如今，我国行政许可立法已进入讨论、酝酿阶段。因此，对行政许可的理论与实践问题进行深入探讨越发重要，也越发紧迫。本文从人与自然资源间的供求关系矛盾，市场经济的缺陷以及行政许可与其他政府行为的不同之处出发，对行政许可存在的价值进行了研究。进而，针对目前行政许可实践中的一些问题，探讨了行政许可程序完善的意义及其程序制度构建。 本文分两大部分。第一部分探讨了行政许可存在的价值。认为人与自然资源间的供求关系矛盾长期存在决定了行政许可的长期存在；“市场失败”是市场经济环境下行政许可存在的根据；而行政许可本身所具有的宏观调控与微观管理相结合以及强力控制与灵活适用并存的特点能使它发挥独特的作用。第二部分从程序规则模式的优越性入手，分析了健全行政许可程序的意义，并提出了健全行政许可程序的制度方案。更多还原

【Abstract】 Administrative license is one of administrative actions. Administrative subjects control opposite side’s actions by it. As one of the law systems, it is very important to perfet market economy. Now, China’s legislative body is making the law about it. So it is more and more important and instant to make a thorough exploring it’s theory and practice. In this article ,the author studies the value of administrative license from three scores: human society’s base characteristic, market economy’s shortcoming and it’s distinct advantage. The author also studies the significance of perfecting administrative license procedure and way to perfect administrative license procedure.This thesis consists of two parts. In the first part, the author studies the value of administrative license. The author holds the view that the contradiction between the human beings and the nature resources is the existent organic base of administrative license; "market failure" is the existent base of administrative license in market economy; macro-control linking micro-administration needs administrative license’s adjustment function in socialistic market economy .In the second part, the author studies it’s procedure perfection. The author analysies procedure’s merit, considers it is significative to perfect administrative license’s procedure and puts over the way to perfect it.更多还原
