片面共犯研究

【摘要】 本文是一篇关于刑法中的片面共犯理论的专题研究论文，全文约三万五千字，除导言外共分六个部分。 片面共犯能否成立及其成立的范围如何，在中外刑法理论上一直存在着争论。本文以比较方法对此进行了深入、系统地研究，认为成立片面教唆犯与片面帮助犯，并在此基础上着重对片面帮助犯的相关问题展开了阐述。在阐释片面帮助犯性质时，对共犯从属性说与共犯独立性说逐一予以详尽评析，得出片面帮助犯的性质是从属性与独立性有机统一的结论，并分析了片面帮助犯的主客观方面构成特征。在认定问题上，重点探讨了片面帮助犯与其他犯罪形态交叉的情况。文章最后就片面共犯的立法完善提出了建议。更多还原

【Abstract】 The dissertation is a research on the theory of Unilateral accomplice in Criminal Law. The dissertation (approximately thirty-five thousand words) Consists of six parts except introduction. Whether Unilateral accomplice can be established or not, in addition to its establishing scope, has always been the question at issue in criminal theory in China and foreign countries. After studying such question by a comparative method systematically and deeply, this dissertation concludes that unilateral sclicitant and unilateral accessory can be established, and then, on the basis of such conclusion, significantly elaborates the questions related to unilateral accessory. When expounding the nature of Unilateral accessory, the author comments on the theory of independence on complicity and that of subordination on complicity in detail, and reaches a conclusion that the quality of unilateral accessory is the organic integration of subordination and independence, and analyses the constitution feature of the subjective aspect and objective aspect of unilateral accessory. The author probes into the intersection of unilateral accessory and the other criminal forms when determining the fact. At last, this dissertation puts forward legislative recommen- dation concerning unilateral accomplice. 2更多还原
