【摘要】 新刑法中增设了侵犯商业秘密罪，这是世界各国较为普遍的一种经济犯罪现象，也是各国理论界、实践部门密切关注的社会问题c对侵犯商业秘密罪的探讨将有助于理解和澄清关于侵犯商业秘密罪的一些认识和看法，为最大效益地执行该法条提供有益的参考。 本文从研究对比各国对“商业秘密”一词所下的定义出发，在个性之下，发掘共性，找出成立商业秘密的基本要素。然后从实践保护的角度出发，提出对商业秘密进行刑法保护的四条原则。最后，就我国此次立法设立侵犯商业秘密罪活条表述中有关模糊及粗疏之处，提出一些个人见解，为使法律更好地得到执行和运用作了一些建言。更多还原

【Abstract】 The crime of commercial esponiage, a kind of uniersal economiccriminal phenomenon all over the world, has been highlighted bytvorldwide academic circles and judicial departments. The research on thecrime of commercial esponiage will help understand and clarify someviews and points about it, and provide a better angel to see through theessence of the crime of commercial esponiage.The author of this article, by comparing the definitions of "tradesecrets" made by various countries, discovers the essential requirementsthat constitute the "trade secrets", and put forward with four priciples forthe protection of trade secrets by criminal law Futhermore, aiming at theconfusion and defects the law brings, the author makes some discussionsand suggestions fOr better operation of the law.更多还原
