【摘要】 工伤保障制度作为社会保障制度的重要组成部分，它的完善与否对我国市场经济体制改革有着极其深远的影响。本文在评述发达国家工伤保障制度的基础上，详尽分析了我国传统工伤保障制度存在的问题及其根源，目的在于通过对这些问题的后果及其内在制约因素的探讨，来考察未来工伤保障制度的走向，寻求适合我国国情的工伤保障制度框架。 本文共分四个部分。 第一部分：工伤风险与工伤保障。从工伤的严重危害谈起，分析指出工伤风险是社会风险，工伤问题是社会问题，并提出解决工伤问题的方式。 第二部分：发达国家（地区）的工伤保障制度。介绍、评述了发达国家（地区）工伤保障制度的特点及其优劣，旨在为构建我国新型工伤保障制度提供一些有益的借鉴。 第三部分：我国工伤保障制度的历史沿革与改革探索。包括两个部分：一部分，通过对传统工伤保障制度的历史回顾，客观地评价了它的功过是非，认为传统工伤保障制度暴露出许多问题的根源在于制度自身的缺陷、社会经济环境的变迁。另一部分，分析、评述了已在进行中的改革实践活动取得的成就和尚存的问题。 第四部分：对我国工伤保障制度的基本构想。以前面的分析为基础，围绕工伤保障制度改革论述了深化改革的条件、改革要实现的目标、改革应坚持的原则，并据此提出构建二元模式的新型工伤保障制度框架，继而指出加速改革进程应采取的相关措施。最后专门就工伤保障与工伤预防、职业康复的有机结合进行了深入探讨。更多还原

【Abstract】 The system of industrial injury insurance (III)is an important part of social insurance system. Its improvement has a great influence upon the reform of marketrientedeconomic system in our country. This thesis comments on the III systems in developed contries, based on which it thoroughly analyses the problems as well as their sources existing in the present situation of traditional Ill systems in our country is condition by discussing the consequence and the internal limitations of these problems. This thesis falls into four chapters. Chapter 1: Industrial Injury Risk and Industrial Injury Insurance. Beginning with the serious harm of industrial injury, this section points out that industrial injury risk is a kind of social risks and the problem of industrial injury is one of social problems. Then it suggests some methods to solve the industrial injury problem. Chapter 2: the Ill System in Developed Countries (Districts). This part introduces the Ill systems in developed countries, and remarks on their advantages and disadvantages in order to present some beneficial reference for founding a new III system of our country. Chapter 3: the Historical Development and Reform Research of the III system in China. The chapter includes two parts: one part comments on the merits and faults of traditional III system objectively through an historical retrospect. It believes that the exposed problems in traditional III system is originated from the defects of the System itself and the change of social economic circumstances. The other part analyses and comments on the achievements and existing problems in the onoing practice of the reform. Chapter 4: the Basic Conception of the III System in China. Based on the analysis above, the thesis focuses on the reform of the III system. It expounds the condition of deepening reform, the target of the reform and the principles that we should hold during the course of the reform. It presents a new framework by two dimensional models for the III System. Then it suggests the relative mesurments which should be taken in speeding up the reform course. Finally it probes the organic combination of industrial injury insurance, industrial injury prevention and career recovery.更多还原
